ՊԵԿ-ի նախագիծը՝ ԱԱՀ գումարների վերադարձի մասին

Պետական եկամուտների կոմիտեն հանրային քննարկման է ներկայացրել նախագիծ, որով առաջարկվում է մինչև 2018 թ.-ի հունվարի 1-ը հաշվետու ժամանակաշրջաններին վերաբերող հաշվարկներով (այդ թվում՝ ճշտված) առաջացող պարտավորությունների և դեբետային գումարների հաշվառման կարգը համապատասխանեցնել օրենքի պահանջներին՝ սահմանելով, որ մինչև 2018 թ.-ի հունվարի 1-ը վերջին հաշվետու ժամանակաշրջաններից տարբերվող`ավելի վաղ այլ հաշվետու ժամանակաշրջանների համար յուրաքանչյուր կիսամյակին հաջորդող ամսվա 21-ի դրությամբ բյուջեից հաշվանցման ենթակա ԱԱՀ գումարները վերադարձվում են հարկ վճարողի դիմումի հիման վրա՝ այդ գումարները միասնական հաշվում հաշվառելու (միասնական հաշվին փոխանցելու) միջոցով, իսկ այդ գումարների հաշվանցումը (մարումը) կատարվում է առանց միասնական հաշվում հաշվառվելու: 

Հստակեցվում է նաև մինչև 2018 թ.-ի հունվարի 1-ը հաշվետու ժամանակաշրջանների համար «դեբետային գումարներ» հասկացությունը, որը հարկ վճարողի ներկայացրած հարկային հաշվարկներով (այդ թվում` ճշտված) առաջացած՝ բյուջեից հաշվանցման ենթակա ավելացված արժեքի հարկի գումարն է: 

Մինչև օրենքի ընդունումը, 2018 թվականի հունվարի 21-ի դրությամբ առկա՝ 2017 թվականի հուլիսի 1-ից մինչև դեկտեմբերի 31-ը ընկած ժամանակահատվածի հաշվետու ժամանակաշրջանների համար ներկայացվող ԱԱՀ-ի հաշվարկներով առաջացած՝ ավելացված արժեքի հարկի դեբետային գումարները չէին փոխանցվում միասնական հաշվին, իսկ այդ գումարների վերադարձը կատարվում էր հարկ վճարողի դիմումի հիման վրա՝ այդ գումարները միասնական հաշվին փոխանցելու միջոցով: 

Օրենքի ընդունումից հետո մինչև ՀՀ հարկային օրենսգիրքն ուժի մեջ մտնելը որևէ կիսամյակին հաջորդող ամսվա 21-ի դրությամբ հարկ վճարողի՝ բյուջեից մարման ենթակա ԱԱՀ գումարը հարկ վճարողի գրավոր դիմումի հիման վրա օրենսգրքի 17-րդ բաժնով սահմանված կարգով իրականացվող ստուգման կամ ուսումնասիրության արդյունքներով հիմնավորվելու դեպքում մուտքագրվում է միասնական հաշվին: 

Խնդիրն այն է, որ կառավարության 2017 թ.-ի հոկտեմբերի 5-ի N1271-Ն որոշմամբ հարկ վճարողի գրավոր դիմումի հիման վրա բյուջեից հաշվանցման ենթակա ԱԱՀ-ի գումարների վերադարձ նախատեսված է միայն 2018 թ.-ի հունվարի 21-ի դրությամբ առկա՝ 2017 թ.-ի հուլիսի 1-ից մինչև դեկտեմբերի 31-ը ընկած ժամանակահատվածի հաշվետու ժամանակաշրջանների համար: 

Մինչդեռ, օրենքով բյուջեից հաշվանցման ենթակա ԱԱՀ-ի գումարների վերադարձ կարող է կատարվել նաև մինչև օրենսգիրքն ուժի մեջ մտնելը ցանկացած կիսամյակի համար: Այս որոշումն ուժի մեջ է մտնում պաշտոնական հրապարակմանը հաջորդող օրվանից և տարածվում է 2020 թ.-ի հունվարի 1-ից ծագած հարաբերությունների նկատմամբ:
