«Անողջամիտ շտապողականություն և փնթի աշխատանք»
POLITICSԻշխանություններն այնքան են շտապում Սահմանադրական դատարանի հետ կապված հարցում, որ հերթական անգամ որդեգրեցին նախ ինչ-որ քայլ անելու, հետո դրա հետևանքների մասին մտածելու գործելաոճը:
Օրեր առաջ համապատասխան օրենսդրական փոփոխությունների քննարկման հարցով հրավիրվեց արտահերթ նիստ, ապա դրա մասին հայտարարությունը մի քանի ժամից հանվեց ԱԺ կայքից՝ «տեխնիկական» պատճառաբանությամբ, հետո էլի հրավիրվեց՝ ներառելով նաև Սահմանադրության մեջ փոփոխություն անելու նախաձեռնությունը, իսկ երբ երեկ առավոտյան պատգամավորները հավաքվեցին, «պարզվեց», որ նախաձեռնողը հետ է կանչել օրենքների փաթեթը՝ էլի «տեխնիկական» պատճառաբանությամբ:
Իսկ իրականությունն այն է, որ փաստացի նման որոշման վրա ազդել էր թե՛ ընդդիմության ու իրավաբանների սուր քննադատությունը և մեղադրանքները, որ իշխանությունները գնում են հակասահմանադրական ճանապարհով, թե՛ նախօրեին ԵԱՀԿ եւ ԵԽ անդամ երկրների հավատարմագրված դեսպանների սուր արձագանքը ԱԺ նախագահի հետ հանդիպման ժամանակ: Հրատապ հրավիրված նոր արտահերթում պարզվեց, որ «իմքայլականները» որոշել են գնալ հանրաքվեի:
«Իշխող ուժը անողջամիտ շտապողականություն է դրսևորում՝ թույլ տալով բոլոր հնարավոր և անհնար, տրամաբանական և ոչ տրամաբանական իրավախախտումները,-«Փաստի» հետ զրույցում նման տեսակետ հայտնեց իրավաբան, Պառլամենտարիզմի զարգացման միջազգային կենտրոնի գործադիր տնօրեն Գոհար Մելոյանը:-Փնթի աշխատանք է տարվում, և՛ ընթացակարգային, և՛ բովանդակային նորմեր են խախտվում։
Բերում են ինչ-որ կիսատ-պռատ, տեխնիկական լուրջ խնդիրներով նախագիծ, հետո հետ են կանչում այն ու նորից բերում, քննադատությունների արդյունքում անընդմեջ կարգեր են փոփոխության ենթարկում։
Այսինքն, եթե իրավական հանրությունը լռեր, պետք է նման փնթի կերպով իրավական, ժողովրդավարական պետության հիմնարար սկզբունքները ոտնահարեի՞ն»։
Ի դեպ, եթե հաշվի առնենք, որ սահմանադրական փոփոխությունների հարցով հանձնաժողով է ստեղծվել, ենթադրելի է, որ մեկ տարվա ընթացքում երկրում երկու հանրաքվե անցկացվի: Այս տեմպերով՝ առնվազն:
