ՀՀԿ-ն դատապարտում է Սահմանադրության փոփոխությունների նախագիծը
POLITICSՀայաստանի Հանրապետական կուսակցությունը խստորեն դատապարտում է իշխանության նախաձեռնված «Հայաստանի Հանրապետության Սահմանադրության փոփոխությունների» նախագիծը։ Այս մասին ՀՀԿ գործադիր մարմնի տարածած հայտարարությունում։
«Իշխանության ղեկին հայտնված, ժողովրդի վստահությունը և ակնկալիքները չարաշահող ավտորիտար պոպուլիստները սահմանադրական փոփոխությունների միջոցով ցանկանում են դադարեցնել մինչեւ Սահմանադրության 7-րդ գլխի ուժի մեջ մտնելը նշանակված Սահմանադրական դատարանի նախագահի եւ անդամների պաշտոնավարումը՝ փոփոխելով Սահմանադրության անցումային դրույթները։
Հարկ ենք համարում ընդգծել, որ սկզբունքորեն ցանկացած իրավական ակտում անցումային դրույթն ունի որոշակի առաքելություն, ուժի մեջ մտնելուց հետո այն կատարում է իր առաքելությունը և այլևս փոփոխության ենթարկվել չի կարող։ Սա հակատրամաբանական, հակաիրավական և հակասահմանադրական փոփոխություն է, որով փորձ են անում դադարեցնել Սահմանադրական դատարանի այն անդամների լիազորությունները, որոնք նշանակվել են 2015 թվականից առաջ գոյություն ունեցած Սահմանադրությամբ։ Տվյալ արկածախնդիր գործընթացը հակասում է Հայաստանի Հանրապետության Սահմանադրության հոդված 168-ի կետ 2-ին, ինչպես նաև հոդված 169-ի 2-րդ մասին:
Առաջարկվող կարգավորումները գործադիր և օրենսդիր ճյուղերի կողմից Սահմանադրական դատարանը մեկուսացնելու և զավթելու փորձ են, որի արդյունքում Սահմանադրական դատարանը զրկվելու է Սահմանադրությամբ նախատեսված իր լիազորությունների իրականացումից, իսկ հանրաքվեի դրական արդյունքի դեպքում ձևավորվելիք սահմանադրական դատարանը կազմված է լինելու բացառապես իշխող ուժին լոյալ ներկայացուցիչներից:
Քննարկվող նախագիծն ուղղակիորեն հակասում է իրավական պետության, իրավունքի գերակայության և ժողովրդավարության սկզբունքներին։ Անտեսելով ԵԽԽՎ-ի կոչերը՝ այն ընդունման պահին չի անցել միջազգային պատկան մարմինների փորձաքննությունը, ինչը աննախադեպ է նորանկախ Հայաստանի ողջ պատմության ընթացքում:
Հաշվի առնելով Հայաստանի պետականությանը սպառնացող այս արկածանդրության ողջ վտանգներն ու հետևանքները՝ Հայաստանի Հանրապետական կուսակցությունը:
Արձանագրում է, որ նախաձեռնած գործընթացի ամբողջ պատասխանատվությունը կրում են թե Նիկոլ Փաշինյանը, թե պետության զավթման հերթական արարի մեջ ներգրավված բոլոր անձիք:
Պատրաստակամ է անհապաղ, ինտենսիվ և լայն քննարկումների պետության առջև ծառացած այս վտանգի հետևանքները կանխելու համար խնդրով մտահոգ բոլոր հասարակական և քաղաքական կառույցների հետ:
Հորդորում է Հայաստանում հավատարմագրված դիվանագիտական ներկայացուցիչներին և միջազգային կառույցներին արձագանքել հակասահմանադրական ճանապարհով Հայաստանի Սահմանադրության փոփոխությունների այս աղաղակող գործընթացին:
Նախազգուշացնում է, որ նման գործողությունները հարված են հասցնում երկրի միջազգային հեղինակությանը և թուլացնում Հայաստանի դիրքերը ռազմավարական և անվտանգային նշանակություն ունեցող գործընթացներում, այդ թվում՝ Արցախյան հիմնախնդրի շուրջ»,-նշված է հայտարարությունում:
