Պարտադիր ժամկետային զինծառայող, շարքային Վահրամ Մկրտիչի Ավագյանի մահվան դեպքի առթիվ քննվող քրեական գործով մեղադրյալ Դավիթ Մովսիսյանի նկատմամբ որպես խափանման միջոց ընտրված կալանավորման դատարանի որոշումը փետրվարի 10-ին բողոքարկվել է ՀՀ վերաքննիչ քրեական դատարանում: Այս մասին այսօր՝ փետրվարի 16-ին, NEWS.am-ի հետ զրույցում հայտնեց Դավիթ Մովսիսյանի փաստաբան Գոռ Գեւորգյանը։

 

«Ցանկացած իրավաբան, եթե վերցնի այդ որոշումը, միակ հետեւությունը, որ կանի՝ կամայական եւ ապօրինի որոշումն է: Դավիթը չի ընդունում իրեն առաջադրված մեղադրանքը: Եթե նայենք, թե ինչի համար է այդ մեղադրանքը առաջադրվել, ապա կասեմ, որ դա իրավական ֆանտազիայի արդյունք է: Ես համոզված եմ, որ շատ կարճ ժամանակահատվածում շատերն անակնկալի են գալու, որովհետեւ իրավական առումով գործ ունենք ուղղակի «բեսպրեդելի» հետ, որովհետեւ այլ կերպ ես չեմ կարող անվանել: Մի խոսքով` շատ ցավալի իրավիճակ ունենք, երբ որ բառիս բուն իմաստով քրեական իրավունքն ու դատավարությունը ոտքի տակ գցած վիճակ է, որովհետեւ այլ կերպ չեմ կարող մեկնաբանել»,- ասաց նա` նշելով, որ կալանքի որոշումը չպատճառաբանված է եւ չհիմնավորված:

 

Փաստաբանը նշեց, որ Դավիթը մահացած զինծառայող Վահրամ Ավագյանի հետ լավ հարաբերությունների մեջ է գտնվել, չի եղել որեւէ կոնֆլիկտ կամ վեճ, որը կարող էր նման ծանր հետեւանքի հանգեցնել:

 

Հիշեցնենք, որ պաշտպանության նախարար Դավիթ Տոնոյանը NEWS.am-ի հետ զրույցում ասել էր, որ Արցախում հունվարի 30-ին մահացած զինծառայող Վահրամ Ավագյանի գործով 3 ձերբակալված կա, որոնցից մեկն էլ նախկին պատգամավոր Առաքել Մովսիսյանի (Շմայսի) որդին է։
