Երևան քաղաքի քննչական վարչության ճանապարհատրանսպորտային հանցագործությունների քննության բաժնում իրականացված լայնածավալ քննչական և այլ դատավարական գործողությունների արդյունքում պարզվել են Իսակովի պողոտայում չորս մարդու մահվան պատճառ դարձած ավտովթարի մի շարք հանգամանքներ, ավտոպատահարի իրական մեղավորը:

 

 

 

Նախաքննությամբ ձեռք բերված փաստական տվյալների համաձայն՝ 2018թ. դեկտեմբերի 26-ին՝ ժամը 23:30-ի սահմաններում, ենթադրյալ հանցագործություն կատարած անձը Երևան քաղաքի ռեստորաններից մեկում մասնակցել է խնջույքի և գտնվելով ալկոհոլի ազդեցության տակ, օգտվելով այն հանգամանքից, որ խնջույքի մասնակիցներից մեկի «Լեքսուս» մակնիշի ավտոմեքենայի շարժիչը գտնվում է գործի դրված վիճակում և վերահսկողությունից դուրս, առանց ավտոմեքենայի սեփականատիրոջ իմացության և թույլտվության, իր ծանոթի հետ նստել է ռեստորանի դիմաց կայանված նշված ավտոմեքենայի ղեկին, իսկ իր ծանոթը՝ ավտոմեքենայի կողքի նստատեղին, և այն վարել Ծովակալ Իսակով պողոտայով թույլատրելի արագությունը գերազանցող շուրջ 105կմ/ժամ արագությամբ, որի ընթացքում կորցրել է ավտոմեքենայի կառավարումը, բախվել պողոտայի միջնամասում առկա բաժանարար բետոնե պատնեշին, ապա՝ դուրս եկել հանդիպակաց ուղեմաս և ընդհարվել հանդիպակաց ուղեմասով ընթացող «Մերսեդես-Բենց» մակնիշի ավտոմեքենային, ինչն անզգուշությամբ առաջացրել է չորս մարդու՝ իր հետ նույն ավտոմեքենայում գտնվող ուղևորի և վթարին մասնակից «Մերսեդես-Բենց» մակնիշի ավտոմեքենայի վարորդի, վերջինիս երկու ուղևորների մահը:

 

Նախաքննության ընթացքում նշված անձը, քրեական պատասխանատվությունից խուսափելու նպատակով, կատարելով սուտ մատնություն, վարույթն իրականացնող մարմնին հայտնել էր, թե, իբր, տեղի ունեցած ավտովթարի ժամանակ ավտոմեքենան վարել է ավտոպատահարի պատճառով մահացած իր ծանոթը:

 

Ձեռք բերված բավարար ապացույցների հիման վրա ապացուցվել է նրա կատարած սուտ մատնությունը և նրան մեղադրանք է առաջադրվել՝ ՀՀ քրեական օրենսգրքի 183-րդ հոդվածի (ավտոմեքենային կամ տրանսպորտային այլ միջոցին ապօրինաբար տիրանալն առանց հափշտակելու նպատակի) 1-ին մասով, 242-րդ հոդվածի (ճանապարհային երթևեկության անվտանգության ապահովմանն ուղղված պահանջները կամ ճանապարհային երթևեկության կամ տրանսպորտային միջոցների շահագործման կանոնները խախտելը) 3-րդ մասով և 333-րդ հոդվածի (սուտ մատնություն) 1-ին մասով: Նրա նկատմամբ որպես խափանման միջոց ընտրվել կալանավորումը:

 

Նախաքննությունն ավարտվել է, և քրեական գործը` մեղադրական եզրակացությամբ, ուղարկվել է դատարան:
