Վերաքննիչ քրեական դատարանի վարույթում է Կարեն Թ.-ի գործով բերված վերաքննիչ բողոքի քննությունը:
Գործը քննվել է Սյունիքի մարզի ընդհանուր իրավասության դատարանում Դավիթ Գրիգորյանի նախագահությամբ:
Ըստ մեղադրանքի՝ ժամկետային զինծառայող, 20-ամյա շարքային Կարեն Թ.-ն, ով դասակի տնտեսական ջոկի խոհարար է եղել, 2015 թվականի հունվարի 23-ից մինչև փետրվարի 6-ը նշանակված է եղել մարտական հերթապահության:
Հունվարի 27-ին, ժամը 19-ն անց 30-ի սահմաններում կատակելու, դիրքի ավագ, դասակի հրամանատար Վահագն Մ.-ին վախեցնելու նպատակով խոհարար Կարենը խախտել է մարտական հերթապահություն կրելու կանոնները:
Նա բարձրացել է գետնատնակի տանիք, այնտեղ ոտնահետքեր է թողել, որից հետո դիրքի ավագին ստել ու զեկուցել է, թե գետնատնակի տանիքին մարդ է տեսել:
Ասածը հավաստի դարձնելու նպատակով նա քարեր է նետել իբր՝ իր տեսած մարդու ուղղությամբ:
Արդյունքում հերթապահության նշանակված անձնակազմը անկանոն կրակ է բացել զինվորի ցույց տված ուղղությամբ՝ ծախսելով ռազմամթերքը:
Ըստ մեղադրանքի՝ զինվորի հակաօրինական արարքի պատճառով խաթարվել է մարտական հերթապահության բնականոն ընթացքը, անձնակազմի մոտ խուճապ է առաջացել, անհարկի օգտագործվել է ռազմամթերքը:
Կարեն Թ.-ին մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 365 հոդվածի 1-ին մասով:
Դատարանում Կարեն Թ.-ն իրեն մեղավոր է ճանաչել, զղջացել է, նրա միջնորդությամբ գործը քննվել է արագացված կարգով:
Դատարանը հաշվի է առել, որ Կարեն Թ.-ն կատարել է զինվորական ծառայության կարգի դեմ ուղղված հանցագործություն, ինչով էական վնաս է պատճառել:
Կարեն Թ.-ն մեղավոր է ճանաչվել ու դատապարտվել է 3 ամիս ազատազրկման: Պատժի սկիզբը կհաշվվի նրան փաստացի կալանքի տակ առնելու օրվանից:
Դատավճիռը բողոքարկել է պաշտպանական կողմը՝ խնդրելով Կարեն Թ.-ի նկատմամբ պայմանական դատապարտություն կիրառել և նրան իրական ազատազրկման չդատապարտել՝ սահմանելով փորձաշրջան:
