Սուրիկ Խաչատրյանի առանձնատան վերաբերյալ հարուցված քրգործը կարճվել է
SOCIETYՍյունիքի նախկին մարզպետ Սուրիկ Խաչատրյանի առանձնատան վերաբերյալ հարուցված քրեական գործը կարճվել է։ Այս լուրը լրատվամիջոցներին հայտնել են ՀՀ գլխավոր դատախազությունից։
Քրեական գործը կարճվել է 2019-ի դեկտեմբերին հանցակազմի բացակայության հիմքով․ «Կ. Ուլնեցու փողոցի 32/11 եւ 32/12 հասցեներում գտնվող առանձնատան գույքահարկի վճարումից Ս. Խաչատրյանի՝ առերեւույթ չարամտորեն խուսափելու, ինչպես նաեւ առանձնատան շինարարության թույլտվությամբ սահմանված ժամկետը երկարաձգելու եւ այդ ժամկետում կառուցապատումն ավարտելու կամ քաղաքաշինական գործունեության օբյեկտն օտարելու վերաբերյալ չնախազգուշացնելով՝ առերեւույթ իրենց ծառայողական պարտականությունները չկատարելու, պաշտոնեական լիազորություններն անցնելու հանգամանքները պարզելու նպատակով քննված քրեական գործով կայացվել է նշված անձանց արարքներում հանցակազմի բացակայության հիմքով քրեական գործի վարույթը կարճելու եւ քրեական հետապնդում չիրականցնելու որոշում»:
Խորությամբ իրականացված լրիվ, օբյեկտիվ եւ բազմակողմանի քննության արդյունքում պարզվել է, որ առանաձնատան շինարարությունը փաստացի ավարտվել է 2016 թվականի 4-րդ եռամսյակում, իսկ Ս. Խաչատրյանի որդու կողմից նախաքննության ընթացքում կատարվել է համապատասխան՝ 4.212.000 ՀՀ դրամի առանձնատան գույքահարկի վճարում․
«Ընդ որում՝ պարզվել է, որ առանձանատան շինարարարությունը 2016 թվականի 4-րդ եռամսյակում ավարտելուց հետո, 2018թ. հունիսի 15-ին, այսինքն դեռեւս մինչեւ «Հետք»-ում այդ առանձնատան վերաբերյալ հրապարակումը եւ դրա հիման վրա ՀՀ դատախազության կողմից ուսումնասիրություններ սկսելը, Ս Խաչատրյանը դիմում է ներկայացրել Երեւանի քաղաքապետին՝ առանձնատան ավարտված շինարարական օբյեկտի շահագործման ընդունող հանձնաժողովի կազմում Երեւանի քաղաքապետարանի աշխատակազմի ներկայացուցչին ներգրավելու վերաբերյալ: Այսինքն՝ գույքահարկ չվճարելու ժամանակահատվածը տվյալ դեպքում հաշվարկվում է 2016թ. 4-րդ եռամսյակից մինչեւ 2018թ. 2-րդ եռամսյակը, որի պարագայում գույքահարկի չափը կազմում է 3.275.903 ՀՀ դրամ: Մինչդեռ ՀՀ քրեական օրենսգրքի 205-րդ հոդվածի 1-ին մասը պատասխանատվություն է նախատեսում խոշոր չափերով՝ 4.000.000 ՀՀ դրամը գերազանցող հարկը, տուրքը կամ պարտադիր այլ վճարը չվճարելու համար, ուստի այս առումով բացակայում է հանցակազմը:
Հիշեցնենք, որ Սուրիկ Խաչատրյանի առանձնատան շինարարության վերաբերյալ քրեական գործ էր հարուցվել քաղաքապետարանի ներկա ու նախկին պաշտոնյաների նկատմամբ։ Գործը հարուցվել էր ՀՀ քրեական օրենսգրքի 308-րդ հոդվածի 1-ին մասի հատկանիշներով՝ պաշտոնատար անձի կողմից շահադիտական, անձնական այլ շահագրգռությունից ելնելով ծառայողական պարտականությունները չկատարելու փաստով։
