Գյումրիում մարտի 5-ին կատարված սպանության դեպքով կալանավորված 28-ամյա երիտասարդը 2016 թվականին կրկին ծեծի է ենթարկել 43-ամյա Մարինեին, վերջինս դիմել է Ոստիկանություն, հարուցվել է քրգործ, սակայն կողմերը հաշտվել են, գործն էլ կարճվել է։ Այս մասին այսօր՝ մարտի 13-ին, լրագրողների հետ զրույցում պատմեց Շիրակի մարզի դատախազ Կարեն Գաբրիելյանը։

Մարզի դատախազը հայտնեց, որ 28-ամյա տղամարդը գրանցված է եղել Գյումրու հոգեկան առողջության կենտրոնում: Նախկինում եղել է 4 անգամ դատապարտված՝ 2-ը՝ հափշտակության, մեկը՝ սպանության սպառնալիքի, մյուսն էլ՝ անձին մարմնական վնասվածք հասցնելու համար։ Հարուցված քրեական գործերի շրջանակներում նշանակված են եղել դատահոգեբուժական փորձաքննություններ, եւ բոլորի արդյունքներով էլ՝ տղան մեղսունակ է ճանաչվել։

Գաբրիելյանը չբացառեց նաեւ, որ փորձաքննության ավարտից հետո հնարավոր է հոդվածի փոփոխություն լինի.

«Երբ կստանանք դիակի դատաբժշկական փորձաքննությունը, ինչպես նաեւ նշված երեխայի նկատմամբ նշանակված փորձաքննությունը, կունենանք կոնկրետ վնասվածքների տեղակայումը, բնույթը, ինտենսիվությունը, ներգործության աստիճանը։ Կնայենք, թե այդ վնասվածքները որքանով են համատեղելի եղել կյանքի համար։ Եթե պարզվի, որ անձը հաճախակի է կնոջը ծեծի ենթարկել, կդիտարկեն նաեւ խոշտանգման հանգամանքը»։

Կարեն Գաբրիելյանը հայտնեց, որ կինը ծեծի է ենթարկվել գիշերը՝ ժամը 02։00-ի սահմաններում, մահը գրանցվել է 14։30-ի սահմաններում. «Նախ ծեծի է ենթարկվել կինը, աղջիկը պաշտպանել է մորը, արդյունքում ծեծի է ենթարկվել նաեւ աղջիկը։ Նախնական տվյալներով ծեծի է ենթարկել բռունցքներով։ Կինը ծեծի է ենթարկվել խանդի պատճառով։ Երեխան մասնակցել է վիճաբանությանը, որպեսզի թույլ չտա իր մորը ծեծի ենթարկի ու արդյունքում իրեն էլ է հարվածներ հասցվել»։

Գաբրիելյանն ասաց, որ 28-ամյա տղամարդը ոչ միայն հրաժարվում է ցուցմունք տալ, այլ նաեւ հրաժարվում է արյան նմուշ հանձնել.

«Օրենքը ասում է՝ ինքը պարտավոր է տալ, սակայն եթե ինքը չի ցանկանում տալ, ապա մենք որեւէ մեխանիզմ չունենք՝ նմուշներ ստանալու։ Եթե իր կամքին հակառակ արյան նմուշ վերցնենք, դուրս կգա, որ խոշտանգում ենք։ Իր խմածության աստիճանը կորոշվի անձանց ցուցմունքների հիման վրա»։

Դատախազը հայտնեց, որ գործի շրջանակներում հարցաքննվել են կալանավորվածի ծնողները, կհարցաքննվեն հարեւանները, դպրոցի աշխատակիցները։

Նշենք, որ 28-ամյա տղամարդն իրեն առաջադրված մեղադրանքը չի ընդունում։

Հիշեցնենք, որ նրան մեղադրանք է առաջադրվել ՀՀ ՔՕ 112-րդ հոդվածի (դիտավորությամբ առողջությանը ծանր վնաս պատճառելը) 2-րդ մասի 1-ին (երկու կամ ավելի անձանց նկատմամբ) եւ 14-րդ (անզգուշությամբ առաջացնելով տուժողի մահ) կետերով:
