«Էրեբունի պլազա» հյուրանոցում հունվարի 23-ին կրակոցներ արձակած 33-ամյա Արթուր Թորոսյանը ճանաչվել է անմեղսունակ։ Այս մասին ԼՈՒՐԵՐ.com-ի հետ զրույցում հայտնեց փաստաբան Էդուարդ Աղաջանյանը։ 

 

 

 

Նրա խոսքով՝ դատահոգեբուժական-հոգեբանական ստացիոնար փորձաքննության եզրակացության համաձայն՝ Արթուր Թորոսյանի մոտ ախտորոշվել է շիզոֆրենիա-պարանոյիկ հիվանդությունը, որի հիմքով վերջինս ճանաչվել է անմեղսունակ. «Նա չի կարող մասնակցել դատաքննչական գործողություններին, քանի որ կարիք ունի հարկադիր բուժման: Օրենքի ուժով՝ անմեղսունակ անձը չի կարող ենթարկվել քրեական պատասխանատվության քրեական օրենսգրքով արգելված արարք կատարելու համար, ուստի՝ նրա նկատմամբ քրեական հետապնդումը դադարեցվելու է և վարույթ իրականացնող մարմինը դիմելու է դատարան՝ հատուկ վարույթի կարգով նրան հարկադիր բուժման տեղափոխելու համար»,- ասաց նա:

 

Փաստաբանը նշեց՝ որոշումը կայացվել է մոտ մեկ շաբաթ առաջ, երբ ստացվել է համապատասխան եզրակացությունը. «Վարույթ իրականացնող մարմինն անհապաղ վերացրել է նրա նկատմամբ որպես խափանման միջոց կալանավորումը: Դիմել էինք դատարան՝  նրա նկատմամբ անվտանգության միջոց կիրառելու միջնորդությամբ, ինչը նույն օրը բավարարվել է և նա կրկին տեղափոխվել է հոգեբուժարան»,- նշեց Աղաջանյանը:

 

Նշենք, որ փետրվարի 17-ին դատարանի որոշմամբ՝ Արթուր Թորոսյանը տեղափոխվել էր հոգեբուժարան՝ ստացիոնար դատահոգեբանական փորձաքննություն անցնելու նպատակով:
