Սերժ Սարգսյանի գրասենյակը պատասխան գրություն է ուղարկել Ապրիլյան քննիչ հանձնաժողովին
POLITICSՀՀ երրորդ նախագահի գրասենյակն այսօր պատասխան գրություն է ուղարկել 2016թ. ապրիլին ծավալված ռազմական գործողությունների հանգամանքները ուսումնասիրելու նպատակով ստեղծված հատուկ քննիչ հանձնաժողովին, որում ասված է.
«Հարգելի՛ պարոն Քոչարյան,
Ս.թ. ապրիլի 8-ին ՀՀ երրորդ նախագահի գրասենյակ ուղարկված Ձեր թիվ ԱԺՀ.2/2514 գրության մեջ պարզորոշ ներկայացված չէ հանձնաժողովի դիրքորոշումը` ի պատասխան գրասենյակի հարցադրումների:
Մասնավորապես, հասկանալի չէ, թե բավարարվե՞լ է արդյոք ՀՀ երրորդ նախագահի առաջադրած պայմանը` հանձնաժողովի լսումներին ներկայանալու միայն իր մասնակցությամբ նիստի ձայնագրությունը (կամ տեսաձայնագրությունը) ստանալու դեպքում:
Եթե նիստի ընթացքում հանձնաժողովը պատրաստվում է ՀՀ երրորդ նախագահին հայտնել պետական և ծառայողական գաղտնիք կազմող` նախագահին անհայտ տեղեկություններ, ապա, ղեկավարվելով «Պետական և ծառայողական գաղտնիքի մասին» ՀՀ օրենքի 20-րդ հոդվածի 1-ին մասի «ա» կետով, Սերժ Սարգսյանը դեմ է դրան և առաջարկում է նման տեղեկություններ չհայտնել:
Իսկ եթե խոսքը վերաբերում է պետական և ծառայողական գաղտնիք կազմող այնպիսի տեղեկությունների, որոնց ՀՀ երրորդ նախագահը տիրապետում է ի պաշտոնե, ապա «Պետական և ծառայողական գաղտնիքի մասին» ՀՀ օրենքի 22-րդ հոդվածի 2-րդ մասի հիման վրա արդեն իսկ առկա է դրանք չհրապարակելու պարտավորություն` անկախ հանձնաժողովի նիստում դրանք հրապարակելուց կամ չհրապարակելուց:
Ելնելով վերոհիշյալից` ակնկալում ենք հանձնաժողովի հստակ դիրքորոշումը` տրամադրվելո՞ւ է արդյոք ՀՀ երրորդ նախագահին` նրա կողմից հանձնաժողովի նիստում հնչեցված հայտարարությունների և պատասխանների տեսաձայնագրությունը:
Ձեր պատասխանից է կախված նիստին մասնակցելու` նախագահ Սարգսյանի որոշումը, ինչի մասին ՀՀ երրորդ նախագահի գրասենյակը իր նախորդ գրությամբ տեղեկացրել էր:
Խնդրում ենք նաև պարզաբանել, թե ՀՀ օրենսդրության որոշակիորեն ո՞ր նորմերից է բխում հանձնաժողովի նիստին պաշտոնաթող նախագահի չներկայանալու դեպում հանձնաժողովին գրավոր հիմնավորումներ ներկայացնելու Ձեր խնդրանքը»:
