ՀՀ ԱԺ հատուկ քննիչ հանձնաժողովը բավարարել է ՀՀ երրորդ նախագահի պայմանը
POLITICSՀՀ երրորդ նախագահի գրասենյակը քիչ առաջ ստացավ 2016թ. ապրիլին ծավալված ռազմական գործողությունների հանգամանքները ուսումնասիրելու նպատակով ստեղծված հատուկ քննիչ հանձնաժողովի պատասխանը գրասենյակի` ս.թ. ապրիլի 8-ի գրությանը, որտեղ ակնկալվում էր հստակ արտահայտել հանձնաժողովի դիրքորոշումը ՀՀ երրորդ նախագահի հարցադրման կապակցությամբ` նկատի առնելով, որ հանձնաժողովի նախորդ գրության մեջ «տեսաձայնագրության տրամադրումը կարող է բավարարվել միայն պետական և ծառայողական գաղտնիքի մասին օրենքի պահանջներին համապատասխան և սահմանված ընթացակարգերի պահպանման արդյունքում» ձևակերպումը բացարձակապես պարզորոշ չէր պատասխանում հարցադրմանը, ինչը արվել է վերջին պատասխանում:
Հանձնաժողովի այսօրվա գրության մեջ հստակ նշված է, որ ՀՀ երրորդ նախագահին առանց որևէ նախապայմանի կտրամադրվի նրա մասնակցությամբ հատվածի տեսաձայնագրությունը:
Նկատի առնելով, որ հանձնաժողովը բավարարել է ՀՀ երրորդ նախագահի կողմից առաջադրված միակ պայմանը` նախագահ Սարգսյանը վերահաստատում է ս.թ. ապրիլի 7-ին հանձնաժողովին ուղղված` գրասենյակի պատասխանում ներկայացված իր որոշումը:
Ի դեպ, հանձնաժողովը այսօրվա իր գրության մեջ չի պարզաբանել, թե ՀՀ օրենսդրության ո՞ր նորմերից է բխում հանձնաժողովի նիստին պաշտոնաթող նախագահի չներկայանալու դեպքում նրա կողմից գրավոր հիմնավորումներ ներկայացնելու խնդրանքը՝ նկատի առնելով, որ ՀՀ երրորդ նախագահի գրասենյակն իր գրության մեջ հստակ վկայակոչել էր այն օրենսդրությունը, ըստ որի նման խնդրանք ներկայացնելը դուրս է հանձնաժողովի լիազորությունների շրջանակից: Եթե հանձնաժողովը չի վկայակոչել օրենսդրության որոշակի նորմեր, ենթադրում ենք, որ վերանայել է այս հարցում իր մոտեցումը:
