Ես նույնպես ունեմ այնպիսի տպավորություն, որ Մարտի 1-ի գործով այս ամբողջ գործընթացի նպատակը Ռոբերտ Քոչարյանին կալանքի տակ պահելն է։ Այս մասին «5-րդ ալիքի» «Հարցազրույց» հաղորդաշարին հայտարարել է նախկին գլխավոր դատախազ Գեւորգ Կոստանյանը։
Գ․Կոստանյանը զուգահեռներ է անցկացրել 2008-ի մարտի 1-ից հետո եւ մեր օրերում հայտարարված արտակարգ դրությունների միջեւ, պարզաբանել, որ իշխանությունն այդպիսի լուծման է գնում, քանի որ սովորական ռեժիմներով չի կարող ապահովել բնակչության անվտանգությունն ու պետության բնականոն գործունեությունը եւ արտակարգ դրություն է հայտարարում, սահմանափակում է մարդկանց ազատությունները սահմանադրական կարգը պաշտպանելու համար․ «Սահմանադրական կարգին սպառնալիքի դեպքում հայտարարվում է արտակարգ դրություն եւ սահմանադրական կարգը չի կարող տապալվել սահմանադրական կարգը պաշտպանելու համար», ասել է նախկին գլխավոր դատախազը։
«Մարտի 1-ի նոր տեսագրություններ են ի հայտ եկել եւ բոլորս էլ տեսել ենք, որ ցուցարարների միջից զինված մարդիկ են կրակում ոստիկանների ուղղությամբ, այսինքն՝ անհրաժեշտություն է ծագում նույն ցուցարարներին պաշտպանել պրովոկատիվ իրավիճակից։ Եվ արտակարգ դրություն չհայտարարելը կարող էր հանգեցնել սահմանադրական կարգի տապալման։
Եթե 2008-ի մարտի 1-ին ես լինեի գլխավոր դատախազը քրեական գործ կհարուցեի նախագահի նկատմամբ, եթե նա չհայտարարեր արտակարգ դրություն։ Որովհետեւ արտակարգ դրություն հայտարարելը ոչ միայն նախագահի իրավունքն է, այլեւ պարտականությունը, որի չկատարելը կարող էր հանգեցնել պատասխանատվության», ասել է Գեւորգ Կոստանյանը։
Գ․Կոստանյանի խոսքով՝ այդ դատավարության ժամանակ տեղի ունեցած մի կարեւոր դրվագով իմաստազրկվել է անձնական երաշխավորության ինստիտուտը։
Նա հիշեցրել է, որ Արցախի 2 նախագահներն են ներկայացել դատարան եւ երաշխավորել Ռ․Քոչարյանի համար, քանի որ, ըստ նրա, մեր իրականության մեջ նրանցից ավելի բարձր հեղինակություն դժվար է պատկերացնել, այնուհանդերձ նրանց միջնորդությունը դատարանի համար վճռորոշ չի եղել։
