Սուրբ Աթոռում ՀՀ նախկին դեսպան Միքայել Մինասյանի նկատմամբ հարուցվել է քրեական գործ և նրան կալանավորելու միջնորդություն է ներկայացվել դատարան: Այս մասին ԼՈՒՐԵՐ.com-ի հետ զրույցում ասաց Մինասյանի պաշտպան Միհրան Պողոսյանը՝ հաստատելով տարածված տեղեկությունը:

 

 

Վերջինս իր պաշտպանյալին առաջադրված մեղադրանքը որակեց որպես դասական պատվերի կատարում ու բացահայտ քաղաքական հետապնդում. «Գոյություն չունի որևէ իրավական հիմնավորում, առհասարակ իրավաբանություն չկա, հետևաբար վստահեցնում եմ, որ այս փնթի կարված գործն անհետևանք չի մնալու ո՛չ պատվիրատուների, ո՛չ կատարողների համար: Ակնհայտ է, որ փորձում են ամեն գնով քրեական հետապնդում սկսել, բայց հրահանգը կատարողները խճճվել են իրենց իսկ գործողություններում ու չկարողանալով ապօրինության գոնե մեկ փաստ առաջ բերել՝ դիմել են գործ կարելու տխրահռչակ մեթոդաբանությանը»,- նշեց նա՝ ընդգծելով, որ վարչապետ Նիկոլ Փաշինյանը 2 տարվա ընթացքում բազմիցս հիմնազուրկ մեղադրանքներ է հնչեցրել Մինասյանի հասցեին ու դրանցից հետո առաջադրված քաղաքական մեղադրանքի ապօրինության և պարզունակության աստիճանը վկայում է իրավական դաշտում ներկայիս ռեժիմի սնանկության մասին։ 

 

Ինչ վերաբերում է մեղադրանքի էությանը, ապա Պողոսյանը նշեց, որ Միքայել Մինասյանին առաջադրված մեղադրանքը ներառում է երկու դրվագ. «Առաջինը վերաբերում է նրան, որ պարոն Մինասյանը անձամբ չի գնացել առևտրային բանկ ու նրա փոխարեն, օրենքով սահմանված կարգով, օգնականն է նրա՝ ՀՀ-ում գտնվող 2 անձնական բանկային հաշվեհամարներին մուտքագրել պարոն Մինասյանին պատկանող դրամական միջոցները, որոնք հետագայում Մինասյանի կողմից փոխանցվել են Իտալիայում գտնվող անձնական բանկային հաշվեհամարին։ Նշված գործողությունը քննչական մարմինը որակել է որպես ապօրինի հարստացում և փողերի լվացում՝ առանց ստուգելու Էթիկայի հանձնաժողով ներկայացված գույքի և եկամուտների հայտարարագրերը, ինչը փաստում է, որ գործ ունենք բացառապես օրինական աղբյուրներից ձևավորված դրամական միջոցների հետ։ Երկրորդ դրվագը վերաբերում է Մինասյանի կողմից դեռևս 2004-ին հիմնադրված ընկերության 20 % բաժնեմասի խնդրին։ Նշված մասով Մինասյանի 2017 թ. հայտարարագրում առկա է տեխնիկական սխալ, քանի որ հայտարարագրում նշված բաժնեմասի վաճառքի գինը և պարոն Մինասյանի կողմից ստորագրված բաժնեմասի վաճառքի պայմանագրում նշված վաճառքի գինն իրար չեն համապատասխանում, ինչը քննչական մարմնի կողմից որակվել է որպես ապօրինի հարստացում։ Նշված սխալը թույլատրվել է այն ընկերության աշխատակցի կողմից, որը դեսպան Մինասյանի հետ կնքված ծառայությունների մատուցման պայմանագրի հիման վրա պատասխանատու է եղել նշված բաժնեմասի հավատարմագրային կառավարման և Էթիկայի հանձնաժողով ներկայացվող հայտարարագրերի լրացման համար։ Ուստի, մենք թե՛ քննչական մարմնին, թե՛ հսկող դատախազին ներկայացրել ենք միջնորդություն այդ ընկերության աշխատակիցներին հարցաքննելու վերաբերյալ, բայց՝ անարձագանք: Ստացվում է՝ քննիչը չի ցանկանում հարցաքննել նշված տեխնիկական սխալը թույլ տված աշխատակցին, որպեսզի բացառվի դեսպան Մինասյանի մեղավորությունը հերքող որևէ փաստական տվյալների մուտքը իր վարույթում քննվող գործին»,- նշեց պաշտպանյանը՝ ավելացնելով, որ այս հանգամանքը ևս փաստում է, որ գործ ունեն ոչ թե քրեական, այլ քաղաքական վարույթի հետ։

 

Փաստաբանը նշեց, որ կալանքի առաջիկա նիստին իրենք ներկայացնելու են սխալ թույլ տված անձի՝ մասնավոր հարցման միջոցով տրված բացատրությունը և հիմք ընդունելով Եվրոպական դատարանի նախադեպային պրակտիկան՝ կմիջնորդեն նշված անձին դատական նիստին հրավիրելու համար։
