Վարչական դատարանը Ռոբերտ Քոչարյանի հայցն ընդդեմ Քրեակատարողական ծառայության վարույթ է ընդունել
POLITICSՎարչական դատարանը դատավոր Ռաֆիկ Խանդանյանի նախագահությամբ վարույթ է ընդունել Ռոբերտ Քոչարյանի հայցն ընդդեմ Քրեակատարողական ծառայության: Այս մասին տեղեկանում ենք Դատական-տեղեկատվական համակարգից:
Դատական նիստը նշանակվել է մայիսի 13-ին, ժամը՝ 15:00-ին:
Նշենք, որ Օրբելյանը հայցին կից ներկայացրել էր միջնորդություն՝ Քոչարյանին ազատ արձակել, մինչեւ համավարակի վտանգն անցնելը, որը դատարանը մերժել է։
«Ռոբերտ Քոչարյանի հայցադիմումն ընդդեմ Հայաստանի Հանրապետության արդարադատության նախարարության քրեակատարողական ծառայության՝ հայցվորի՝ ՀՀ Սահամանդրության 26-րդ եւ Կոնվենցիայի 3-րդ հոդվածներով երաշխավորված իրավունքի խախտում թույլ տալուց ձեռնպահ մնալուն պարտավորեցնել, այն է՝ հայցվոր Ռոբերտ Քոչարյանին քրեակատարողական հիմնարկում պահելը մինչեւ կորոնավիրուսուվ պայմանավորված համավարակի տարածման վտանգի ամբողջական վերացումը առնվազն մինչեւ ՀՀ բոլոր քաղաքացիների նկատմամբ կիրառված տեղաշարժի սահմանափակման դադարեցումը, նշվածն ամեն դեպքում ներառում է մինչեւ ժամկետի ավարտը բացառել պարոն Ռոբերտ Քոչարյանի պահելը որեւէ քրեակատարողական հիմնարկում եւ ապահովել անհապաղ ազատ արձակումը քրեակատարողական հիմնարկից մինչեւ դատարանի որոշմամբ սահմանված ժամկետը, պահանջի մասին, վերադարձնել»,- ասվում է որոշման մեջ։
Հիշեցնենք, որ NEWS.am-ի հետ զրույցում Քոչարյանի ներկայացուցիչ Արամ Օրբելյանը հայտնել էր, որ հայցվոր կողմը պահանջում է կանխել նրա իրավունքները խախտող գործողությունները, մասնավորապես, անմարդկային վերաբերմունքը եւ խոշտանգումները Ռոբերտ Քոչարյանի նկատմամբ:
Արամ Օրբելյանը նշել էր, որ իրենց հայցադիմումի հիմք է հանդիսացել նաեւ միջազգային կառուցների՝ ՄԱԿ-ի եւ ԵԽ-ի մարդու իրավունքների հանձնակատարների, ինչպես նաեւ Առողջապահության համաշխարհային կազմակերպության հայտարարությունները, որ պետությունները պետք է քայլեր ձեռնարկեն այլընտրանքային խափանման միջոցներ կիրառելու։
