Փաստաբան Տիգրան Սարգսյանը՝ ոստիկանական վերջին խուզարկումների և քաղաքացիների անվստահության մասին
INTERVIEW
Վերջին օրերին ոստիկանությունն ակտիվորեն հասարակական վայրերում զննում և խուզարկում է քաղաքացիներին: Past.am-ը ոստիկանության գործողությունների օրինականությունը պարզելու նպատակով զրուցել է «Սարգսյան իրավաբանական խումբ» իրավաբանական միավորման ղեկավար, փաստաբան Տիգրան Սարգսյանի հետ:
-Պարոն Սարգսյան, ինչո՞վ է պայմանավորված ոստիկանների գործողություններին քաղաքացիների ընդդիմանալու հակումը:
-Քաղաքացու համար դժվար է հասկանալ՝ ոստիկանի պահանջն օրինակա՞ն է, թե՞ ոչ, քանի որ քաղաքացին ձեռքի տակ չունի օրենսդրությունը, չգիտի, թե որ իրավական ակտերով են կարգավորվում ոստիկանի իրավունքները և պարտականությունները: Սակայն, շատ կարևոր է, որ քաղաքացին համոզված լինի ոստիկանի գործողությունների օրինականության հարցում, հակառակ դեպքում բախումն անխուսափելի է:
-Ինչպե՞ս պետք է գործի ոստիկանը, որ քաղաքացու համար լինի համոզիչ և վստահելի:
-Տպավորությունն այնպիսին է, որ քաղաքացիները չեն վստահում ոստիկանությանը և այս անվստահությունը կարելի է հաղթահարել, եթե ոստիկանությունը ճիշտ աշխատատի: «Ոստիկանության մասին» ՀՀ օրենքի 5-րդ հոդվածի 4-րդ մասի համաձայն՝ ոստիկանության ծառայողները մարդու իրավունքների ու ազատությունների սահմանափակման ցանկացած դեպքում անմիջապես պարտավոր են նրա համար մատչելի և հասկանալի լեզվով ներկայացնել սահմանափակման հիմքերն ու պատճառները, ծանոթացնել և բացատրել դրանից բխող իրավունքներն ու պարտականությունները, ինչպես նաև աջակցել իրավունքների իրացմանը:
Մարդու խնդրանքով իր իրավունքների ու պարտականությունների ծանուցումը կատարվում է գրավոր: Եթե օրենքի այս պարզ պահանջը պահպանվի, ապա ոստիկանությունը կնվաճի մեր քաղաքացիների վստահությունը:
Իրականում, ոստիկանները նույնիսկ իրենք ծանոթ չեն «Ոստիկանության մասին» ՀՀ օրենքին, դրանով էլ պայմանավորված չեն կարողանում հասկանալի բացատրել իրենց պահանջների օրինական լինելը:
Հիմնականում ոստիկանն իր գործողությունները հիմնավորում է վերևից հրահանգ լինելու հանգամանքով, ինչը բնական է, որ խորացնում է անվստահությունը և բացառում համագործակցությունը:
Դրա փոխարեն ոստիկանը պետք է իր ձեռքում ունենա «Ոստիկանության մասին» ՀՀ օրենքը և երբ մոտենում է քաղաքացուն, պետք է ցույց տա օրենքի այն հոդվածը, որով ինքն իրավասու է նշված գործողությունն անել: Նման մոտեցումը շատ բան կփոխի մեր հասարակությունում:
