ԱԺ փորձաքննության խնդիրներն ու իմքայլականների քվեարկությունը․ աղմկահարույց նախագծի հետքերով
POLITICS«Ժողովուրդ» թերթը գրում է․ «Երեկ խորհրդարանում առաջին ընթերցմամբ թեժ քննարկվեց և ընդունվեց «Արտակարգ դրության իրավական ռեժիմի մասին» օրենքում փոփոխություններ եւ լրացումներ կատարելու մասին» եւ «Նորմատիվ իրավական ակտերի մասին» օրենքում լրացում կատարելու մասին» օրենսդրական փաթեթը:
Սահմանվել է, որ անձնական ազատության իրավունքը կարող է սահմանափակվել արտակարգ դրության պայմաններում կիրառվող միջոցառումների իրականացման համար ներգրավված մարմինների կողմից տրված գրավոր կամ բանավոր կարգադրությամբ: Եվ պատգամավորների առաջարկների հիման վրա վերոնշյալ դրույթն առաջինից երկրորդ ընթերցում փոփոխության կենթարկվի. անձի ազատությունը կսահմանափակվի գրավոր կարգադրության հիման վրա, իսկ եթե հանգամանքներից ելնելով հնարավոր չէ ապահովել տվյալ պահին գրավոր ձեւակերպումը, ապա բանավոր կարգադրությամբ` պայմանով, որ սեղմ ժամկետում կհետեւի գրավոր կարգադրությունը:
Նշենք, որ բանավոր կարգավորման հարցը ամենաքննադատվողներից է եւ անգամ բացասական է եղել արձագանքը ԱԺ պետաիրավական փորձաքննության բաժնի կողմից։ Նրանք եզրակացության մեջ նշել էին, որ դիմումի հիման վրա հարուցված վարչական վարույթի արդյունքում կարող է ընդունվել միայն գրավոր վարչական ակտ:
Երեկ խորհրդարանում օրենքն ընդունվեց 82 կողմ, 13 եւ ձեռնպահ 14 ձայներով։ Ուշագրավ է, որ եղել են իշխող խմբակցության պատգամավորներ, որոնք այս նախագծի քվեարկությանը չեն մասնակցել։ Նրանք են՝ Սոնա Ղազարյանը, Արսեն Միխայլովը, Կնյազ Հասանովը, Հրաչյա Հակոբյանը, Տաթևիկ Գասպարյանը։
ԼՀԿ-ն դեմ է քվեարկել, իսկ ԲՀԿ-ականները որոշեցին ձեռնպահ մնալ՝ սպասելով իրենց առաջարկները ընդունմանը։ Եվ չնայած երեկ նախագիծն առաջին ընթերցմամբ ընդունվեց և այսօր պետք է փոփոխություններ լինեն, սակայն ընդդիմադիր ուժեր ԲՀԿ-ն եւ ԼՀԿ-ն բազմաթիվ առաջարկներ են ներկայացրել, սակայն դրանք փոփոխված տարբերակում այդպես էլ տեղ չեն գտել»։
