Ինչո՞ւ է Լանզարոտեի կոնվենցիան հրատապ կարգով ընդունվել արտակարգ դրության պայմաններում. Արա Զոհրաբյան

«ԻՆՉՈ֩Ւ Է ԼԱՆԶԱՐՈՏԵԻ ԿՈՆՎԵՆՑԻԱՆ ՀՐԱՏԱՊ ԿԱՐԳՈՎ ԸՆԴՈՒՆՎԵԼ ԱՐՏԱԿԱՐԳ ԴՐՈՒԹՅԱՆ ՊԱՅՄԱՆՆԵՐՈՒՄ
Հայաստանի նոր իշխանությունների որոշ ներկայացուցիչներ հետաքրքիր մարտավարություն են ընտրել:
Եթե պետք է ճնշել որևէ անձի կամ մարմնի, ապա ժողովրդի օգնությանն ու իմաստությանն են դիմում ու գործում են ժողովրդի անունից (օրինակ՝ ԱԺ, դատարաններ):
Եթե պետք է այնպիսի նախաձեռնություն առաջ տանեն, որտեղ այդ նույն ժողովուրդն այլ մոտեցում ունի, ապա ժողովուրդը զրկվում է իմաստությունից և դուրս է մղվում այդ գործընթացներին մասնակցելուց (օրինակ՝ Ամուլսար, Ստամբուլյան կոնվենցիա, Լանզարոտեի կոնվենցիա): Չնայած հանուն արդարության պետք է նշեմ, որ որոշ գործընթացներ վարչապետը կասեցրել է ժողովրդի «ճնշման» ներքո:
Եթե որևէ քաղաքացի, այդ թվում՝ մասնագետ, քննադատական կարծիք է հայտնում իշխանության նախաձեռնության վերաբերյալ, ապա որակվում է հակահեղափոխական՝ զուգորդված ֆեյքահարձակումներով կամ պետական «ուշադրությամբ»:
Պետական բարձրաստիճան պաշտոն զբաղեցնող որոշ անձինք չեն թաքցնում իրենց հակակրանքը այլ կարծիք ունեցողների նկատմամբ, վերջիններիս կարծիքները որակելով ապատեղեկատվական, մանիպուլյատիվ, մոլորեցնող և այլն:
Ստամբուլյան կոնվենցիայի և Լանզարոտեի կոնվենցիայի առնչությամբ իմ կարծիքները նույնպես արժանացել են նման որակումների:
Հիմա հարցերս ուղղում եմ այդ պաշտոնատար անձանց՝
- Դուք դրա համար եք եկել իշխանության, որ այլակարծությունը խեղդե֩ք.
- Ինչո֩ւ է ձեզ խանգարում իմ կամ մի քանիսի տարբերվող կարծիքը և ինչ֩ու տարրական հարգանք չեք ցուցաբերում այլ անձանց կարծիքների հանդեպ.
- Ինչո֩ւ Լանզարոտեի կոնվենցիան նախապես հանրային քննարկման չներկայացրեցիք, քաղաքակիրթ բանավեճեր չկազմակերպեցիք, մարդկանց մտահոգությունները չփարատեցիք.
- Ինչո֩ւ Լանզարոտեի կոնվենցիան հրատապ կարգով ընդունեցիք արտակարգ դրության պայմաններում, ո֩րն էր այդ շտապողականության նպատակը:
Հիշեցնեմ ձեզ, որ դուք իշխանության եք եկել, որպեսզի ստորև նշված նվազագույն պայմաններն ապահովեք՝
- Ժողովրդավարական պետության գործունեության հիմնական սկզբունքը բազմակարծությունն է.
- Ժողովրդավարական իշխանությունը հավասար չափով հաշվի է առնում բնակչության անհատական և ազգային առանձնահատկությունները.
- Ժողովրդավարական ռեժիմը իշխանությունների (այդ թվում՝ գործադիր և օրենսդիր) ԻՐԱԿԱՆ տարանջատման հետևանք է.
- Քաղաքացու անհատական իրավունքների և ազատությունների իրական երաշխիքները, ինչպես նաև պետության քաղաքականության մասին իր սեփական կարծիքն ազատորեն արտահայտելու նրա հնարավորությունը պետության ժողովրդավարական ռեժիմի մասն են կազմում»:
