POLITICSՎերջերս Ազգային ժողովում տեղի ունեցած և դրան հաջորդող իրադարձությունները քաղաքական շրջանակներում դարձել են բուռն քննարկումների առարկա:
«Մեկ Հայաստան» կուսակցության նախագահ Արթուր Ղազինյանն անդրադառնալով ԱԺ-ում մեծ աղմուկ հանած ծեծկռտուքին, ֆեյսբուքյան իր էջում գրել է.
«ԱԺ-ում տեղի ունեցած իրադարձությունները և դրան հաջորդած «քաղաքական ելույթները», ինձ մոտ՝ որպես իրավաբանի, առաջացնում են մի շարք հարցեր, որոնց պատասխաններն ակնկալում է ստանալ մեր հասարակության եթե ոչ բոլոր, ապա, համենայն դեպս, գերակշիռ մասը։
Այսպես.
1. բոլորիս աչքի առաջ Սասուն Միքաելյանը, ապա նաև «Իմ քայլը» խմբակցության առնվազն երկու այլ պատգամավորներ, ԱԺ նիստերի դահլիճում ծեծի ենթարկեցին ընդդիմադիր խմբակցության ղեկավարին՝ վարչապետ Փաշինյանի լուռ համաձայնությամբ: Վերոնշյալ անձանց արարքն իր մեջ առերևույթ առնվազն պարունակում է ՀՀ քրեական օրենսգրքի 118-րդ հոդվածով (ծեծ կամ այլ բռնի գործողություններ կատարելը) նախատեսված հանցակազմի տարրեր, չնայած որ կարող է քննարկվել նաև խուլիգանության հանցակազմը։
Հաջորդիվ, ՀՀ վարչապետ Նիկոլ Փաշինյանն իր ելույթում անդրադառնալով հիշատակված միջադեպին, հավելեց, որ դատապարտում է բռնության ցանկացած դրսևորումները, ապա՝ հպանցիկ նախատելով իր ընկեր և եղբայր Սասուն Միքաելյանին բացառապես սադրանքներին տրվելու համար, ստանձնեց վերջինիս պաշտպանի դերը, եվ ԻՐԱՎԱԿԱՆ պետության գլխավոր ամբիոնից փորձեց արդարացնել առերևույթ հանցավոր արարքը:
Չցանկանալով խախտել անմեղության կանխավարկածի սկզբունքը, ես զերծ կմնամ քննարկվող միջադեպը հանցագործություն որակելուց, բայց եվ այնպես, ինձ համար ամենևին անհասկանալի մնաց վարչապետի կողմից մեջբերած կաշառքի պրովոկացիայի դրվագը։
Ակնհայտ է, որ վերջինս դրանով փորձում էր անալոգիա կիրառել և տեղի ունեցածը հասարակությանը մատուցել որպես պրովոկացիայի կամ սադրանքի արդյունք, դրանով իսկ արդարացնելով բռնություն գործադրած անձանց արարքը։
Ստիպված եմ արձանագրել, որ վարչապետը չի տիրապետում ՀՀ օրենսդրությանը և չգիտի, որ ի տարբերություն կաշառքի պրովոկացիայի, ՀՀ որևէ իրավական ակտում չկա ծեծի կամ այլ բռնի գործողությունների պրովոկացիայի մասին հիշատակում, եվ միևնույն ժամանակ ՀՀ օրենսդրությամբ նմանատիպ դեպքերում օրենքի անալոգիայի կիրառումն անթույլատրելի է։
