ANALYSISԻ՞նչ ճնշումների է ենթարկվում դատավորը կամ իր ընտանիքի անդամները, չեմ կարող ասել, բայց միանգամայն հասկանալի է, որ այս որոշումն ընդունողը ոչ թե դատավորն էր, այլ Նիկոլ Փաշինյանը: Այս մասին ankakh.com-ի հետ զրույցում ասել է «ԱԺՄ» ղեկավար, «Վերնատուն» հասարակական-քաղաքական ակումբի նախագահ Վազգեն Մանուկյանը։
Պարոն Մանուկյան, մայիսի 13-ին դատարանը՝ Աննա Դանիբեկյանի նախագահությամբ, մերժեց Արցախի Հանրապետության առաջին եւ ՀՀ երկրորդ նախագահ Ռոբերտ Քոչարյանի փաստաբանների երեք միջնորդությունը, այդ թվում Ձեր եւ ՀՀ նախկին վարչապետերի եւ Արցախի նախկին վարչապետի անձնական երաշխավորությամբ խափանման միջոց կալանավորումը փոխելու վերաբերյալ: Ի՞նչ եք կարծում, սա քաղաքակա՞ն որոշում էր:
Ցանկացած իրավաբան հասկանում է, որ որեւէ իրավական հիմք չկար մերժելու այդ միջնորդությունները, հատկապես այս կորոնավիրուսի վտանգի պայմաններում, երբ աշխարհի բոլոր երկրներում մարդկանց խափանման միջոցը փոխում են: Հետեւաբար, դատավորը՝ որպես իրավաբան, նման որոշում ընդունել չէր կարող: Ի՞նչ ճնշումների է ենթարկվում դատավորը կամ իր ընտանիքի անդամները, չեմ կարող ասել, բայց միանգամայն հասկանալի է, որ այս որոշումն ընդունողը ոչ թե դատավորն էր, այլ Նիկոլ Փաշինյանը:
Հարց է առաջանում՝ ինչու՞ է Նիկոլ Փաշինյանն այդպիսի որոշում ընդունեց:
Առաջին ենթադրությունը վրեժխնդրությունն է: Բայց այս պայմաններում, այսքան ժամանակ ազատազրկման մեջ պահելուց հետո, այն էլ, իմ կարծիքով, ոչ հիմնավոր գործի համար, վրեժխնդրության նման զգացում ունենալը չարության այնպիսի աստիճան է ենթադրում, որ նույնիսկ Նիկոլ Փաշինյանի դեպքում չեմ կարծում: Իհարկե, վրեժխնդրությունը նշանակություն ունի, բայց միայն դրանով բացատրել հնարավոր չէ:
Երկրորդ ենթադրությունը, որ հնարավոր է անել, այն է, որ Նիկոլ Փաշինյանն արդեն զգում է, որ կորցնում է ժողովրդին, առջեւում թեժ քաղաքական պայքար է սպասվում, եւ վախենում է, որ Ռոբերտ Քոչարյանը կլինի այդ պայքարի կիզակետում: Դա հիմնավոր չէ, քանի որ կալանքից ազատվելով քաղաքականությամբ զբաղվելու դեպքում նույն րոպեին նրան կարող են նորից կալանավորել՝ մեկնաբանելով որպես խափանման միջոցի փոփոխման պայմանների խախտում:
Երրորդ ենթադրությունն այն է, որ Նիկոլ Փաշինյանը որոշակի պարտավորություններ է վերցրել արտաքին ուժերի նկատմամբ, եւ դա կապված է Արցախի հարցի լուծման հետ: Դա բնական ենթադրություն է, բայց բոլոր դեպքերում Ռոբերտ Քոչարյանի դատավարությունը մայիսի 8-ին նշանակելն ու նրան բանտում պահել շարունակելը ոչ միայն մեծ նվեր է մեր թշնամիներին, այլ նաեւ մեծ հարված մեր հաղթանակին, այդ հաղթանակի համար զոհված մեր հազարավոր հերոսներին եւ այդ հաղթանակի կերտման տասնյակ հազարավոր մասնակիցներին, ու դա անհետեւանք չի մնալու: Կարծում եմ՝ Նիկոլ Փաշինյանն արժանի է Ալիեւի կողմից շքանշան ստանալու:
Հնարավո՞ր է, որ այդ որոշումը կայացվեց նաեւ իր կողմնակիցների եւ իր համակիրների՝ առանց այդ էլ նոսրացող շարքերը պահելու համար:
Ես կարծում եմ, որ ժողովուրդն այսօր զբաղված է իր հոգսերով, եւ նույնիսկ իր կողմնակիցների մի զգալի մասն արդեն կորցրել է այն զգացումը, որ Ռոբերտ Քոչարյանն անպայման պետք է մնա կալանքի տակ: Ինչ վերաբերոմ է իր ամենամոլի համակիրներին ու կողմնակիցներին, ապա կալանքից ազատելու որոշումը նրանց համար կարող էր հասկանալի լինել այն հանգամանքով, որ Ռոբերտ Քոչարյանին ամեն գնով կալանքի տակ պահելը վնասակար է հենց իրենց՝ իշխանության համար:
Ամեն դեպքում, այդ որոշումը սեւ բիծ է մեր պետության ու ժողովրդի համար, եւ կգա ժամանակ, երբ արդեն բոլորս կամաչենք այդ որոշման համար:
