«Հայկական արժեքների պաշտպանության կամք» հասարակական նախաձեռնության անդամ Արթուր Ալեքսանյանի պաշտպան Էմին Բեգլարյանը պատրաստվում է բողոքարկել նրան 2 ամսով կալանավորելու որոշումը։ NEWS.am-ի հետ զրույցում փաստաբանը ասաց, որ աշխատում է բողոքարկման դիմումի վրա եւ ավարտելուն պես այն կներկայացնի ՀՀ Վերաքննիչ քրեական դատարան:

Հիշեցնենք՝  Արթուր Ալեքսանյանը կալանավորել է պաշտոնյայի նկատմամբ բռնություն գործադրելու սպառնալիքի գործով․տուժող է ճանաչվել ԱԺ «Իմ քայլը» խմբակցության պատգամավոր Նիկոլայ Բաղդասարյանը։

Պաշտպանական կողմը գտնում է, որ մեղադրանքն անհիմն է եւ ապօրինի քրեական հետապնդում է իրականացվել Արթուր Ալեքսանյանի նկատմամբ:

«Առհասարակ չէր կարող 316 հոդվածի հատկանիշներով քրեական գործ հարուցվել, առավել եւս այդ գործի շրջանակներում ձերբակալվել եւ կալանավորել,, քանի որ քրեական օրենսգրքի 316-րդ հոդվածի 3-րդ մասը հստակ սահմանում է, թե  իշխանության ներկայացուցիչ ով կարող է հանդիսանալ: Ըստ էության իշխանության ներկայացուցիչ կարող է հանդիսանալ պետական կամ տեղական ինքնակառավարման այն անձը, ով որ ծառայության շրջանակներից դուրս սահմանված կարգով ունի կարգադրիչ լիազորություններ: Այս դեպքում ԱԺ պատգամավորը որեւէ կարգադրիչ լիազորություն չունի, այսինքն չի կարող հասարակ քաղաքացիների խմբին որեւէ իրավաչափ պահանջ ներկայացնել: Ըստ էության վարույթն իրականացնող մարմինը փորձում է մեկնաբանել, որ քանի որ ԱԺ-ն  մեր օրենսդիր մարմինն է, օրենսդիր մարմնի ներկայացուցիչն էլ հանդես է գալիս որպես իշխանության ներկայացուցիչ, սակայն դա այդպես չէ»,-ասաց պաշտպանը:

Անդրադառնալով միջադեպին` փաստաբանն ասաց, որ Արթուր Ալեքսանյանը  չի ընդունում իրեն առաջադրված մեղադրանքը. «Նա չի հերքում, որ հեծանիվով է եղել, բայց վրաերթ չի կատարել եւ բռնության սպառնալիքներ չի հնչեցրել»:

Հիշեցնենք, որ «Կամք» նախաձեռնության անդամ Արթուր Ալեքսանյանը ձերբակալվել էր մայիսի 13-ին  պատգամավոր Նիկոլայ Բաղդասարյանի հաղորդման հիման վրա։ Նշենք, որ Բաղդասարյանը մայիսի 11-ին իրավապահ մարմինների հաղորդել էր, որ Ալեքսանյանը Սահմանադրական դատարանի մոտ ժամը 17։00-17։15 ընկած ժամանակահատվածում փորձել էր իրեն հեծանիվով վրաերթի ենթարկել, իր հասցեին սպառնալիքներ ու հայհոյանքներ էր հնչեցրել։
