«Հանրաքվեի մասին» սահմանադրական օրենքում փոփոխություններ կլինեն

Կառավարությունն այսօր հերթական նիստին հավանություն տվեց «Հանրաքվեի մասին» սահմանադրական օրենքում փոփոխություններ և լրացումներ կատարելու մասին» օրենքի նախագծին, որով առաջարկվում է, որ այն դեպքերում, երբ ռազմական կամ արտակարգ դրությունը հայտարարվել է սույն օրենքով նախատեսված հանրաքվեն նշանակվելուց հետո, ապա մինչև ռազմական կամ արտակարգ դրություն հայտարարելն սկսված հարցը հանրաքվեի դնելու հետ կապված բոլոր գործողություններն ու ժամկետները կասեցվում են օրենքի ուժով:

Ըստ նախագծի՝ռազմական կամ արտակարգ դրություն հայտարարելուց հետո 12 ժամվա ընթացքում Կենտրոնական ընտրական հանձնաժողովը հանդես է գալիս հանրաքվեն կասեցնելու մասին հայտարարությամբ: Հանրաքվեն վերսկսվում է ռազմական կամ արտակարգ դրության ավարտից հետո սույն օրենսգրքով սահմանված կարգով:

Նախագծով նախատեսված է, որ արտակարգ կամ ռազմական դրության պատճառով կասեցված հանրաքվեն անցկացվում է ռազմական կամ արտակարգ դրության ավարտից ոչ շուտ, քան 50 և ոչ ուշ, քան 65 օր հետո: Ռազմական կամ արտակարգ դրության ավարտից հետո՝ եռօրյա ժամկետում, Հանրապետության նախագահը ընդունում է հրամանագիր, որով նշանակվում է կասեցված հանրաքվեի գործընթացը մեկնարկելու օրը և քվերակության օրը, որը պետք է լինի կիրակի:

Վերսկսված հանրաքվեի գործընթացը մեկնարկելու օրվա և քվեարկության օրվա միջև ժամանակահատվածը չի կարող պակաս լինել ռազմական կամ արտակարգ դրության պատճառով կասեցված հանրաքվեի կասեցման օրվանից մինչև քվեարկության օրն ընկած ժամանակահատվածից: Կենտրոնական ընտրական հանձնաժողովն իրավասու է պատճառաբանված որոշմամբ փոփոխելու առանձին գործողությունների կատարման ժամկետների հաշվարկը՝ պայմանավորված վերսկսված հանրաքվեի պատշաճ կազմակերպման անհրաժեշտությամբ և սահմանելու վերսկսված հանրաքվեի գործընթացի նախապատրաստման և անցկացման հիմնական միջոցառումների նոր ժամանակացույց:

Հանրաքվեի վերսկսումից հետո քարոզչության կողմերը կարող են օգտագործել իրենց հիմնադրամներում մնացած միջոցները: Ռազմական կամ արտակարգ դրության պատճառով կասեցված հանրաքվեի հիմնադրամների հաշվին կուսակցությունների, հասարակական կազմակերպությունների կամ կուսակցությունների դաշինքների մուծումների չափը քարոզչության հիմնադրամ յուրաքանչյուրի համար չի կարող գերազանցել նվազագույն աշխատավարձի 40 000-ապատիկը:

Ըստ հիմնավորման՝ «Հանրաքվեի մասին» սահմանադրական օրենքը չի կարգավորում նշանակված, բայց ռազմական կամ արտակարգ դրության պատճառով չանցկացված հանրաքվեն ռազմական կամ արտակարգ դրության վերացումից հետո անցկացնելու ընթացակարգը, ուստի նախագծով առաջարկվում է սահմանել այդ ընթացակարգը: Նախագծի նպատակն է սահմանել նշանակված, սակայն ռազմական կամ արտակարգ դրության պատճառով չանցկացված հանրաքվեն ռազմական կամ արտակարգ դրության վերացումից հետո անցկացնելու ընթացակարգը:

«Քաղաքացիական նախաձեռնության կարգով ներկայացված օրենքի նախագծի վերաբերյալ Սահմանադրական դատարանի կողմից` Սահմանադրությանը համապատասխանության մասին որոշումն ընդունվելուց, ինչպես նաև Ազգային ժողովի կողմից հանրաքվե անցկացնելու մասին որոշումն ընդունվելուց հետո` եռօրյա ժամկետում, Հանրապետության նախագահը նշանակում է հանրաքվե: Հանրաքվեն անցկացվում է հանրաքվե նշանակվելուց ոչ շուտ, քան հիսուն, և ոչ ուշ, քան վաթսունհինգ օր հետո»:
