POLITICS«Հրապարակ» թերթը գրում է. «Իշխանություններն անհամբեր սպասում են, թե ինչ պատասխան կտա Վենետիկի հանձնաժողովը հանրաքվեի չեղարկման, ՍԴ դատավորներին առնչվող իրենց հարցումներին»,- ասաց սահմանադրագետը:
Ի՞նչ ժամկետներում կպատասխանեն։ «Նայած թե ինչ են պայմանավորվել միմյանց հետ, բոլոր դեպքերում կարծում եմ, որ Վենետիկի հանձնաժողովը դժվար թե համաձայնություն տա 12 տարի պաշտոնավարած դատավորների նկատմամբ իշխանության «նկրտումներին», իշխանություններն այդ 3 դատավորի հարցը կլուծեն ԱԺ-ում` կարճ ժամկետում կատարելով սահմանադրական փոփոխություններ»:
Երեքն են` Ֆելիքս Թոխյանը, Ալվինա Գյուլումյանը, Հրանտ Նազարյանը: «Բոլորն էլ նշանակվել են Տեր-Պետրոսյանի ժամանակ, Ռոբերտ Քոչարյանի ժամանակ նշանակված դատավոր չկա, եթե իշխանությանը հաջողվի նրանց պաշտոնանկ անել, կմնան Սերժ Սարգսյանի եւ Նիկոլ Փաշինյանի ժամանակ նշանակված դատավորները»:
Իսկ ինչո՞ւ են ուզում հանել այդ երեքին։ «Ենթադրում են, որ ՍԴ բալանսը կփոխվի՝ Թովմասյանին նորերը չեն ընտրի։ Վստահ եմ՝ սխալվում են․ Հրայրը կընտրվի, որովհետեւ բալանսը կրկին իր օգտին է, ընդ որում` ԱԺ-ում սահմանադրական փոփոխությունների ժամանակ պետք է նաեւ դրույթ ընդունեն, որ ՍԴ նախագահին նորից պետք է ընտրեն, այլապես իրավունք չունեն Հրայր Թովմասյանին կրկին ընտրել»: Կարծում եք՝ դատավորների վրա ճնշում չե՞ն գործադրի։
«Ճնշում կգործադրեն բոլորի վրա, սակայն արդյունքը կլինի նույնը, մանավանդ որ այնքան բան է փոխվել»: Այդ սահմանադրական փոփոխություններն ի՞նչ ժամկետում կարող են լինել։ «ԱԺ-ում օրենքի փոփոխությունը բավականին արագ` արտահերթ նիստով, իսկ նոր դատավորների ընտրությունն առավել երկար ժամանակ կպահանջի, եւ կրկին մինչ այդ յա՛ էշը կսատկի, յա՛ իշատերը»:
