Որքան տուգանք է սահմանված, եթե հանրային տրանսպորտի վարորդը չի կատարում պարետի պահանջները

Պարետի որոշմամբ սահմանված պահանջները հանրային տրանսպորտի վարորդի կողմից չկատարելու դեպքում տվյալ ուղևորափոխադրում իրականացնող կազմակերպության ղեկավարը սահմանված կարգով կարող է տուգանվել 100-300 հազար դրամի չափով: Մայիսի 23-ին մամուլի ասուլիսի ժամանակ ասաց ՀՀ քաղաքաշինության, տեխնիկական և հրդեհային անվտանգության տեսչական մարմնի ղեկավարի տեղակալ Արտյուշ Գրիգորյանը։

 

«Եթե այդ պահանջը խախտվել է ուղևորի կողմից, ապա տուգանքը նվազագագույն աշխատավարձի տասնապատիկի չափով է: Մեր հսկողության ընթացքում այս հինգ օրերի ընթացքում հիմնականում շեշտադրումը կատարել ենք կանխարգելիչ գործողությունների, իրազեկման աշխատանքների վրա: Վարորդներին կամ ուղևորին տուգանելը նպատակ չէ, այլ  կանխարգելիչ գործողության մի մասն է: Նշեմ, որ խախտումների դեպքում երթուղին կարող է դադարեցվել, մինչև որոշման պահանջը չի կատարվի»,-ասաց Գրիգորյանը։

ՀՀ Ոստիկանության հասարակական կարգի ապահովման վարչության պետի տեղակալ Էդգար Պետրոսյանը իր հերթին ներկայացրեց, թե ինչ ընթացակարգ է տեղի ունենում, եթե վարորդը չի պահպանում պարետի պահանջները․

«Առաջին հերթին ոստիկանության ծառայողի կողմից պահանջ է ներկայացվում շտկել խախտումը։ Ինչպես նշվեց պատասխանատվության է ենթարկվում ոչ թե տնտեսվարող սուբյեկտի մոտ գործունեություն իրականացնող վարորդը, այլ հենց տնտեսվարող սուբյեկտը։ Վարորդը պատասխանատվության է ենթարկվում վարչական իրավախախտումների վերաբերյալ օրենսգրքի 182․3 հոդվածի 2-րդ մասով, նախատեսվում է պատիժ՝ 100-ից 300 հազար դրամ։ Եթե վարորդի կողմից ոստիկանության պահանջը չկատարվի, ապա վարորդը անձնապես պատասխանատվության կենթարկվի վարչական իրավախախտումների վերաբերյալ օրենսգրքի 182-րդ հոդվածով, այն է՝ ոստիկանության ծառայողի օրինական պահանջի չկատարելը, որի դեպքում հնարավոր է իրականացնել վարչական ձերբակալում»։
