Պաշտոնյաներին օր չի մնացել․ ի՞նչ պատիժներ կլինեն
POLITICS«Ժողովուրդ» թերթը գրում է․ «Բարձրաստիճան պաշտոնյաների համար գույքի, եկամուտների եւ շահերի տարեկան հայտարարագիրը Կոռուպցիայի կանխարգելման հանձնաժողով ներկայացնելու ժամկետը, ըստ էության, ավարտվեց: Ինչպես հայտնի է, կառավարության որոշմամբ՝ այն նախատեսված էր մինչեւ այս տարվա մարտի 31-ը, սակայն հանձնաժողովը որոշեց երկարացնել այն մինչեւ մայիսի 31-ը: Այս հետաձգումն առաջին հերթին պայմանավորված էր նոր համակարգի ներդրմամբ եւ շահագործմամբ, որը լրացուցիչ խնդիրներ էր առաջացրել:
Եվ չնայած արդեն ոչ աշխատանքային օրեր են, եւ նախատեսված ժամկետը մոտենում է իր ավարտին, այնուամենայնիվ Կոռուպցիայի կանխարգելման հանձնաժողովի նախագահ Հայկուհի Հարությունյանը «Ժողովուրդ» օրաթերթի հետ զրույցում տեղեկացրեց, որ մինչ օրս հայտարարագրման ենթակա պաշտոնյաներից ոչ բոլորն են հայտարարագրերն ուղարկել: «80 տոկոսը ներկայացրել է, մնացածն էլ այս օրերի ընթացքում կներկայացնեն: Դա օրենքի պարտավորությունն է, 31-ը վերջին օրն է, երբ կարող են ներկայացնել իրենց հայտարարագրերը: Խնդիրներ եղել են, մենք պետք է դրանք ամփոփենք, եւ առաջիկայում կներկայացվեն: Տեխնիկական խնդիրներ եղել են, եւ մենք ի սկզբանե էլ ասել էինք, որ բազան չափազանց հին է եւ առաջացնում է խնդիրներ», – նշեց Հարությունյանը:
Հանձնաժողովի նախագահի տեղեկացմամբ՝ հայտարարագիրը չներկայացնելու դեպքում օրենքով սահմանված քայլեր, պատիժներ կհետեւեն։
Հիշեցնենք, որ հայտարարագիր չներկայացնելը վարչական իրավախախտում է համարվում՝ համաձայն «Վարչական իրավախախտումների վերաբերյալ» օրենքի 169.28 հոդվածի: Երկու նախազգուշացումից հետո գործը պետք է ներկայացվի դատախազություն։ Օրենքում հստակ գրված է. «Հայտարարագիր ներկայացնելու պարտականություն ունեցող անձի կողմից նախատեսված հայտարարագրերը օրենքով սահմանված ժամկետները լրանալուց հետո` 30 օրվա ընթացքում Կոռուպցիայի կանխարգելման հանձնաժողովի գրավոր ծանուցման հիման վրա չներկայացնելը առաջացնում է տուգանքի նշանակում` սահմանված նվազագույն աշխատավարձի երկուհարյուրապատիկի չափով»:
