«Ժողովուրդ». Փաստահավաք խմբի վերաբերյալ քննարկում են արել ու դժգոհել. ինչ է սպասվում
POLITICS«Ժողովուրդ» թերթը գրում է․ «Ինչպես հայտնի է, ՀՀ արդարադատության նախարարությունն իրավական ակտերի հրապարակման միասնական կայքում հանրային քննարկման է ներկայացրել Փաստահավաք խմբի ձեւավորման հարցը, որը պետք է գնահատական տա անցյալում կատարված խախտումներին՝ 1991-ից մինչեւ 2018 թվականների ընդգրկումով:
Սակայն «Ժողովուրդ» օրաթերթը տեղեկացավ, որ մինչ այս կայքում նախագծի հրապարակումը՝ 2019 թվականի վերջին, արդեն նման հանրային քննարկում է եղել նախագիծը կազմելու շուրջ, որին մասնակցել են ներայացուցիչներ Արդարադատության նախարարությունից, փորձագետներ, օրենսդիր մարմնից ներկայացուցիչներ: Եվ, մեր տեղեկություններով, ներկաներն այնքան էլ ոգեւորված չեն եղել այս խմբի ստեղծումով՝ այն համարելով նաեւ ավելորդ ֆինանսական բեռ եւ ծանրաբեռնվածություն: Բանն այն է, որ այս հանձնաժողովն ունենալու է առանձին բյուջե՝ արտացոլված պետական բյուջեի նախագծում:
Տեղեկացանք, որ քննարկումը կազմակերպվել էր դեկտեմբերին՝ փոխնախարար Ռաֆիկ Գրիգորյանի գլխավորությամբ, իսկ ընդդիմադիր խմբակցություններից ներկա են եղել Անի Սամսոնյանն ու Գեւորգ Պետրոսյանը: Սակայն ուշագրավ է, որ իշխող խմբակցությունից ոչ ոք ներկա չի եղել քննարկմանը:
Իշխանությունն այս փաստահավաք խումբը դիտարկում է որպես անցումային արդարադատության գործիքներից մեկը: Ուսումնասիրության առարկա, ըստ նախագծի, կդառնան ընտրություններն ու հանրաքվերը կեղծելու, ընտրակաշառք բաժանելու դեպքերը, քաղաքական հետընտրական հետապնդումները, ունեզրկման դեպքերը, այդ թվում՝ հանրության գերակա շահի անվան տակ կազմակերպված, նաեւ ոչ մարտական պայմաններում զինծառայողների մահվան դեպքերը։ Նախագծով հանձնաժողովը պետք է ձեւավորված լինի 2021-ի սկզբին, գործողության ժամկետը երկու տարի է, խիստ անհրաժեշտության դեպքում կարող է երկարաձգվել եւս մեկ տարով: Հանձնաժողովն ունենալու է 9 անդամ, որոնք ընտրվելու են Ազգային ժողովի կողմից։ Հանձնաժողովի 9 անդամներից երեքի թեկնածությունը առաջարկելու են կառավարությունը, Բարձրագույն դատական խորհուրդը եւ Մարդու իրավունքների պաշտպանը։
Իսկ մնացած վեց թեկնածուներին ներկայացնելու են Ազգային ժողովի խմբակցությունները։ Բայց այստեղ մի հետաքրքիր մեխանիզմ կա. յուրաքանչյուր խմբակցություն, բացի իր թեկնածուին ներկայացնելուց, ներկայացնում է նաեւ հասարակական կազմակերպություններից մեկական ներկայացուցչի»։
