Կրկնապատկվել են նախատեսվող տուժանքների գումարային չափերը
SOCIETYՇրջակա միջավայրի նախարարությունը հանրային քննարկման է ներկայացրել նախագիծ, որով առաջարկում է փոփոխություններ և լրացումներ կատարել վարչական իրավախախտումների վերաբերյալ ՀՀ օրենսգրքում:
Նախագծով առաջարկվել է վարչական իրավախախտումների վերաբերյալ օրենսգրքի 63րդ հոդվածը լրացնել նոր մասերով, որոնց համաձայն տարափային ջրահեռացման և ցամաքուրդային համակարգեր կեղտաջրեր արտանետելու, կենտրոնացված ջրահեռացման համակարգ տարափային և ցամաքուրդային ջրեր ընդունելու, ինչպես նաև ոռոգման համակարգերի աղտոտման համար սահմանվել է վարչական պատասխանատվություն:
Նախագծի 8-րդ հոդվածով նախատեսված կարգավորումների սահմանման նպատակը լողափերում հանգստացողների և լողացողների անվտանգությունը ապահովելն է, Սևանա լճում արդյունագործական որսի ընթացքում թույլատրված ռեսուրսի օգտագործման նկատմամբ պատշաճ մակարդակով հսկողություն և վերահսկողություն իրականացնելն է, ինչպես նաև իրավախախտումների նկատմամբ կանխարգելիչ քաղաքականության վարումը:
Նախագծի 9-րդ հոդվածով հստակեցվել է ջրային համակարգերի կառավարման լիազորված մարմնի լիազորությունները՝ կապված ջրային համակարգերի կառավարման լիազորված մարմնին կամ այդ մարմնի համակարգի կազմակերպություններին հանձնված ջրային համակարգերի մասով նախատեսված վարչական իրավախախտումների վերաբերյալ գործերի քննության և վարչական տույժեր նշանակելու հետ։
Նախագծով խստացվել են նաև վարչական օրենսգրքի ջրային ռեսուրսների և ջրային համակարգերի օգտագործմանն ու պահպանությանը վերաբերող 61-րդ, 62-րդ, 63-րդ, 63.1-րդ, 63.3-րդ, 63.4-րդ, 63.5-րդ, 63.6-րդ հոդվածներով նախատեսված սանկցիաները:
Այդ հոդվածներով վարչական պատասխանատվություն ենթադրող սանկցիաների կիրառման ժամանակ կրկնապատկվել են նախատեսվող տուժանքների գումարային չափերը, քանի որ վերոնշյալ հոդվածների դեսպոզիցիաներում ներկայացված ջրային ռեսուրսների և ջրային համակարգերի օգտագործման ու պահպանության կանոնների խախտմանն ուղղված գործողություններն առաջացնում են ջրերի աղտոտում, աղբոտում, հյուծում և այլ վնասակար երևույթներ:
«Վարչական իրավախախտումների վերաբերյալ ՀՀ օրենսգրքում փոփոխություններ և լրացումներ կատարելու մասին» օրենքի նախագծի ընդունման կապակցությամբ պետական կամ տեղական ինքնակառավարման մարմնի բյուջեում եկամուտների և ծախսերի ավելացում կամ նվազեցում չի նախատեսվում:
Վարչական պատասխանատվության կիրառման դեպքում նախատեսվում է պետական բյուջեների եկամտային մասի ավելացում։
