Գագիկ Ծառուկյանի փաստաբանական խումբը դիմել է դադախազութույն՝ քրեական գործ հարուցելու համար

Վարչապետի ընտանիքին պատկանող armtimes.com կայքում օրերս նյութ հրապարակվեց՝ «Բարգավաճ Հայաստան» կուսակցության ղեկավար Գագիկ Ծառուկյանի մասնակցությամբ տարիներ առաջ տեղի ունեցած խմբակային բռնաբարության գործով դատավճռի վերաբերյալ՝ հղում տալով համացանցին։
Հրապարակված նյութի վերաբերյալ Ծառուկյանը որոշել է դիմել գլխավոր դատախազություն՝ քրեական գործ հարուցելու համար։
«Հրապարակ»-ի հետ զրույցում նրա ներկայացուցիչ Էմին Խաչատրյանն ասաց, որ դիմելու են այսօր․ «Ներկայացանելու ենք հանցագործության մասին հաղորդում, քանի որ այս վերջին հրապարակումները «Հայկական ժամանակ», «Անհերքելի փաստեր» էջում եւ մի քանի այլ կայքերում, իր վերաբերյալ 79 թվականի դատավճիռ էին հրապարակել ամբողջ ծավալով, որը, մեր կարծիքով, պարունակում է քրեական օրենսգրքի 144 հոդվածի հատկանիշներ (Մարդու անձնական կամ ընտանեկան կյանքի մասին տեղեկություններ ապօրինի հավաքելը, պահելը, օգտագործելը կամ տարածելը): Սահմանադրությամբ հստակ նշված է, որ դռնփակ անցկացվող դատական նիստերը ու դրանց եզրափակիչ որոշումները հրապարակման ենթակա չեն։ Մենք այստեղ 308 հոդվածի (պաշտոնեական դիրքի չարաշահում) խնդիր էլ ենք տեսնում»։
Նա չնշեց, թե կոնկրետ ում նկատի ունի, երբ ասում է՝ պաշտոնեական դիրքի չարաշահում․ «Չենք կարող ասել, որովհետեւ նման հստակ տվյալներ չունենք, բայց այդ հրապարակումները, եթե ուշադիր ուսումնասիրենք, ապա էջերի վերեւի հատվածում գրիչով համարակալումներ կան, այսինքն՝ նշանակում է, որ այդ նյութերը վերցված են քրեական գործի արխիվից։ Այդ նյութերը չէր կարող հասանելի լիներ երրորդ անձի, եթե ինչ-որ պաշտոնատար անձ կամ անփութություն, կամ պաշտոնեական դիրքի չարաշահում թույլ չտար»։
Փաստաբանը նաեւ ավելացրեց, որ պատրաստում են հերքման պահանջ ներկայացնել այն լրատվամիջոցներին, որոնք հրապարակել են այդ տեղեկությունը․ «Քանի որ տեղեկատվությունն ամբողջական չի եղել, արդարացման վերաբերյալ որեւէ բան չի հրապարակվել, հերքման պահանջ կներկայացնենք։ Համացանցում հրապարակումներ կան արդեն արդարացման վերաբերյալ։ Ամեն դեպքում՝ չեն ուշանա իրավական գործընթացները, որովհետեւ անթույլատրելի բաներ են կատարվում»։
