POLITICSԿարող են պատգամավորները դիմել Սահմանադրական դատարան՝ հիմքում ընդունելով Սահմանադրության 168-րդ հոդվածի 4-րդ կետը: Այս մասին Tert.am-ի հետ զրույցում ասաց արդարադատության նախկին նախարար Դավիթ Հարությունյանը՝ անդրադառնալով հարցին, թե արդյոք ընդդիմադիր պատգամավորները Սահմանադրության փոփոխությունների նախագծի համապատասխանության հարցով կարող են դիմել Սահմանադրական դատարան:
«Բանն այն է, որ Սահմանադրական դատարանին իրավասություն է վերապահվում լուծելու սահմանադրական մարմինների միջեւ նրանց սահմանադրական լիազորությունների առնչությամբ առաջացող վեճերը, եւ այս լիազորությունը, որը նախատեսել է Սահմանադրությունը, սերտորեն կապված է խորհրդարանական փոքրամասնությունների իրավունքների ուժեղացման հետ: Նպատակը հետեւյալն է, որ պատգամավորների մեկ հինգերորդը կարող է դիմել ընդդեմ Ազգային ժողովի՝ թե' գործողության, թե' անգործունության, թե' իրավական ակտի հետ կապված դեպքերում, եթե համարում է, որ Սահմանադրությամբ իրեն վերապահված լիազորությունները վտանգված են կամ խախտվել են»,-ասաց նա:
Դավիթ Հարությունյանը նշեց, որ տեսնում է, որ կա ակնհայտ հիմք եւ բոլոր նախադրյալները` Սահմանադրական դատարան դիմելու: «Միանշանակ հնարավոր է դիմել Սահմանադրական դատարան, առկա է երկու հիմք` նույն հոդվածի հիման վրա: Առաջինը՝ Ազգային ժողովի անգործունությունն է, որը չի դիմել Սահմանադրական դատարան՝ եզրակացություն ստանալու: Չէ որ պատգամավորը որոշում կայացնելուց քվեարկում է կողմ, թե դեմ կամ մասնակցում է կամ չի մասնակցում քվեարկությանը, Սահմանադրությամբ պետք է հնարավորություն ունենա՝ ունենալու Սահմանադրական դատարանի եզրակացությունը, եւ զրկելով պատգամավորին այդ իրավունքից` մենք զրկել ենք իրեն ամենակարեւոր սահմանադրական լիազորություններից մեկից»,-ասաց նա եւ նշեց, որ Ազգային ժողովի անգործությունը հիմք է:
Երկրորդ հիմքը Դավիթ Հարությունյանը Ազգային ժողովի ընդունած իրավական ակտը համարեց: «Այսինքն` Սահմանադրության փոփոխությունը, որով Ազգային ժողովի մեծամասնությունը հնարավորություն է ստանում լրացնել Սահմանադրական դատարանի դատավարների զգալի մասը, անմիջական վտանգ է ստեղծում Սահմանադրության վերապահված իրավասությունները ապագայում խախտման համար: Չէ որ նույն մեկ հինգերորդը կարող է հետագայում վիճարկել որեւէ օրենքի սահմանադրականությունը Սահմանադրական դատարանում, եւ եթե այդ Սահմանադրական դատարանը հիմնականում ստեղծվում է իշխող մեծամասնության կողմից, իսկ այս նախագիծը դրան է հանգեցնելու, ապա նշանակում է, որ մեկ հինգերորդի դիմումը քննվելու է ոչ լեգիտիմ Սահմանադրական դատարանի կողմից, որի անկախությունը եւ անաչառությունը երաշխավորված չէ»,-ասաց նա:
Այսպիսով` Դավիթ Հարությունյանը նշեց, որ առկա է առնվազն երկու հիմք, երկուսն էլ ընկնում են 168-րդ հոդվածի չորրորդ կետի տակ, որով պատգամավորների մեկ հինգերորդը կարող է դիմել Սահմանադրական դատարան: Նա դա համարեց ստեղծված իրավիճակի լուծումներից մեկը:
Հիշեցնենք, որ ԱԺ «Լուսավոր Հայաստան» խմբակցության ղեկավար Էդմոն Մարուքյանն անդրադարձել է ԱԺ կողմից ընդունված Սահմանադրության փոփոխությունների փաթեթին ՀՀ Սահմանադրությունը` 2015 թ. խմբագրությամբ, իրավունք չի տալիս պատգամավորներին դիմել Սահմանադրական դատարան այս հարցով։
