«Սա միայն ՍԴ-ի կամ առանձին դատավորների խնդիրը չէ»
POLITICSՍԴ հարցով իրադարձությունները ուշագրավ ընթացք են ստանում: Սահմանադրական հայտնի փոփոխությունների մասին խորհրդարանի օրենքը, որն արդեն մասնագիտական ու քաղաքական հանրությունը որակել է հակասահմանադրական, հրապարակվել է ԱԺ նախագահի կողմից և այսօր պետք է ուժի մեջ մտնի: Զուգահեռ ՍԴ դիմելու նախաձեռնությամբ է հանդես եկել ԲՀԿ-ն, իսկ ԼՀԿ-ն իր չմիանալը պայմանավորում էր Ռոբերտ Քոչարյանի գործոնով:
Եվ ահա երեկ երկրորդ նախագահի պաշտպանական թիմը որոշեց հետ վերցնել Սահմանադրական դատարան մեկ տարի առաջ ներկայացրած դիմումները։ «Փաստի» հետ զրույցում իրավաբան Ռոբերտ Հայրապետյանը նշում է, որ սա «երկրի իրավական անվտանգության համար մտածող մարդու քայլ է»:
Նրա կարծիքով, «սա սոսկ ՍԴ-ի կամ ընդամենը Հ. Թովմասյանի խնդիրը չէ: Սա ամբողջ երկրի խնդիրն է, որովհետև նման անօրինական և հակասահմանադրական գործողությունների թողտվությունը վաղը կամ մյուս օրը հանգեցնելու է յուրաքանչյուրիս նկատմամբ ցանկացած սահմանափակման և ռեպրեսիայի կիրառման»:
Ի դեպ, առկա իրավիճակին ու մասնավորաբար ԼՀԿ խուսանավող, մշուշոտ հայտարարություններին երեկ ողջ օրն անդրադառնում էին նաև այլ քաղաքական ուժեր: Մասնավորաբար, «Մեկ Հայաստան» կուսակցության նախագահ Արթուր Ղազինյանը Ռոբերտ Քոչարյանի թիմի որոշումը գնահատել էր որպես «բավական համարձակ քայլ»՝ միևնույն ժամանակ հավելելով. «Բարոյական չեմ համարում «Լուսավոր Հայաստանի» այն պնդումը, որ Ռոբերտ Քոչարյանի գործով դատարանի որոշման հիմքով իրենք հրաժարվում են տալ այն ստորագրությունները, որոնք անհրաժեշտ են Հայաստանում պետական և սահմանական կարգը վերականգնելու և Հայաստանում իրավական պետությունը երաշխավորելու համար»:
