Սահմանադրական դատարանի թնջուկը․ օրենքում պետք է կրկին փոփոխություն անեն
POLITICSՍահմանադրական դատարանի շուրջ նոր զարգացումներ են սպասվում։ Մասնավորապես, տեղեկացանք, որ երկուշաբթի կամ երեքշաբթի փոփոխություններ են արվելու Սահմանադրական դատարանի մասին օրենքում, որպեսզի երեք դատավորների՝ Ալվինա Գյուլումյանի, Հրանտ Նազարյանի եւ Ֆելիքս Թոխյանի լիազորություններն ավարտված համարվեն։
Ինչպես հայտնի է, Ազգային ժողովի նախագահ Արարատ Միրզոյանն այսօր հանդիպել էր Սահմանադրական դատարանի նախագահի պարտականությունները կատարող Աշոտ Խաչատրյանին։ Քանի որ սահմանադրական փոփոխությունները մտել են ուժի մեջ, մինչ ՍԴ նախագահի նոր ընտրությունը, բարձր դատարանի նախագահի պարտականությունները ստանձնում է դատարանի կազմից տարիքով ավագը, որը այս դեպքում հենց Աշոտ Խաչատրյանն է։
Սակայն չնայած դրանք ուժի մեջ են մտել, սակայն Սահմանադրական դատարանի անդամները շարունակում են պնդել, թե իրենք պաշտոնավարում են, իսկ ՍԴ նախագահն էլ Հրայր Թովմասյանն է։ Բանն այն է, որ Սահմանադրական դատարանի հաղորդագրության համաձայն, միայն սահմանադրական փոփոխություններով հնարավոր չէ պաշտոնանկ անել Հրայր Թովմասյանին ու դադարեցնել 3 դատավորների լիազորությունները, եւ պետք է փոփոխություններ արվեն նաեւ Սահմանադրական դատարանի մասին օրենքում։
Եվ ահա, մեր տեղեկություններով, այսօր Արարատ Միրզոյանի հետ հանդիպումից հետո պայմանավորվածություն է ձեռք բերվել, որ համապատասխան փոփոխություններն ամենասեղմ ժամկետներում կկատարվեն, որպեսզի հնարավոր լինի փոփոխությունները մինչեւ վերջ ավարտին հասցվեն։ ArmLur.am-ը տեղեկացավ, որ այժմ ԱԺ պետաիրավական հանձնաժողովի անդամները լծված են Սահմանադրական դատարանի մասին օրենքում փոփոխություններ կատարելու գործին ,եւ պետք է մի քանի դրույթներ փոխվեն։ Ընդ որում, մեր տեղեկություններով, նրանց առջև ժամկետ է դրվել, ամենաուշը երեքշաբթի օրը պետք է աշխատանքներն ավարտին հասցնել, որպեսզի ԱԺ արտահերթ նիստ հրավիրվի, քննարկվի փոփոխությունները։
ArmLur.am-ը մեկնաբանության համար դիմեց ԱԺ նախագահի խորհրդական Վահան Կոստանյանին՝ հասկանալու համար, թե ինչ հարցեր են քննարկվել այսօր հանդիպման ժամանակ։ «Քննարկվել են համագործակցության հետագա քայլերը», – նշեց նա։
Դիտարկմանը՝ Սահմանադրական դատարանի մասին օրենքի փոփոխության մասին խոստում եղել է Միրզոյանի կողմից, Կոստանյանը նկատեց․ «Այլ մանրամասներ չունեմ, որպեսզի փոխանցեմ։ Հետագա քայլերը մյուս շաբաթ առավել առարկայական կլինեն արդեն»։
Ստացվում է՝ Սահմանադրական դատարանը մեկ բան է ասում, Ազգային ժողովը մեկ այլ, եւ իրավիճակն այդպես էլ չի հանգուցալուծվում։
