Փոփոխվում է Սահմանադրական դատարանի դատավորների թափուր տեղերի համար առաջադրող մարմինների առաջադրման հերթականությունը
POLITICSԱԺ-ն արտահերթ նիստում քննարկում է Սահմանադրական դատարանի մասին օրենքում փոփոխություններ ու լրացումներ կատարելու մասին և Պաշտոնատար անձանց գործունեության ապահովման, սպասարկման ու սոցիալական երաշխիքների օրենքում փոփոխություններ կատարելու մասին նախագծերի փաթեթը։
«Իմ քայլը» խմբակցության պատգամավոր Վահագն Հովակիմյանն ասաց, որ հունիսի 26-ին ուժի մեջ են մտել Սահմանադրության փոփոխությունները։ Այդ փաստով պայմանավորված՝ Սահմանադրական դատարանի մասին օրենքի 88-րդ հոդվածի անցումային դրույթները անհրաժեշտ է համապատասխանեցնել Սահմանադրության 213 հոդվածի նոր խմբագրությանը։ Փաթեթի համահեղինակ «Իմ քայլը» խմբակցության պատգամավոր Սուրեն Գրիգորյանն էլ ներկայացրեց փաթեթով նախատեսվող փոփոխությունները։
«Փոփոխվում է Սահմանադրական դատարանի դատավորների թափուր տեղերի համար առաջադրող մարմինների առաջադրման հերթականությունը։ Առաջադրումները կատարվելու են հետևյալ հերթականությամբ՝ առաջին առաջադրումը կատարվելու է կառավարության կողմից, երկրորդը՝ հանրապետության նախագահի, երրորդը՝ Դատավորների ընդհանուր ժողովի կողմից։ Սահմանադրական դատարանում այս պահին առկա երեք թափուր պաշտոնների համար այդ առաջադրումները կատարվելու են հետևյալ հերթականությամբ՝ այս փոփոխությունը պայմանավորված է այն հանգամանքով, որ եթե հերթականությունները պահպանվեն գործող խմբագրությամբ, ինչպես սահմանված է, այն է՝ Հանրապետության նախագահ, Դատավորների ընդհանուր ժողով և կառավարություն, կխախտվի Սահմանադրության 166-րդ հոդվածի առաջին մասի պահանջը»,- ասաց նա։
Նախագծով փոփոխություններ ու լրացումներ են կատարվում նաև Սահմանադրական դատարանի մասին օրենքի 88-րդ հոդվածում, որի անհրաժեշտությունը, Սուրեն Գրիգորյանի խոսքով, պայմանավորված է 2020 թվականի հունիսի 22-ին ԱԺ կողմից ընդունված և հունիսի 26-ից ուժի մեջ մտած Սահմանադրական փոփոխությունների 213-րդ հոդվածով կատարված փոփոխություններով։ «Նախ այս հոդվածով ուժը կորցրած է ճանաչվում այն բոլոր դրույթները, որոնք ի սկզբանե դատավորներին հնարավորություն էին ընձեռում գնալ, այսպես կոչված, վաղ կենսաթոշակի։ Հոդվածում կատարվում են հետևյալ լրացումները՝ ամրագրվում է, որ Սահմանադրական դատարանի անդամներին, դատավորներին, որոնց լիազորությունները դադարել են լիազորությունների ժամկետն ավարտելու հիմքով, վերջիններիս նշանակվում է կենսաթոշակ՝ օրենքով սահմանված կարգով»,- հավելեց նա։ Ամրագրվում է նաև, որ ՍԴ նախագահն ընտրվում է ՍԴ կազմի համալրումից հետո 10 օրյա ժամկետում։
