Ինքնասպանություններն ու ինքնավնասումները նվազեցնելու նպատակով
SOCIETYԱրդարադատության նախարարությունը հանրային քննարկման է ներկայացրել նախագիծ, որի ընդունմամբ հնարավորություն կստեղծվի գործնականում բացառել կյանքից զրկելու համար օգտագործվող հնարավոր միջոցներին այն դատապարտյալների և կալանավորված անձանց հասանելիությունը, որոնք իրենց կյանքին կամ առողջությանը վնաս պատճառելու հակում ունեն՝ այդ անձանց որպես բացասական հակում ունեցող հաշվառման վերցնելուց մինչև նման հաշվառումից հանելն ընկած ժամանակահատվածում:
Ներկայումս օրենսդրական կարգավորման բացակայության պայմաններում արդարադատության նախարարության ՔԿՀ-ներում ազատությունից զրկված անձինք, որոնք ունեն իրենց կյանքին, առողջությանը վնաս պատճառելու հակում, գործնականում հասանելիություն են ունենում այնպիսի միջոցների, որոնք կարող են օգտագործվել իրենց առողջությանը վնաս հասցնելու, ընդհուպ մինչև՝ կյանքից զրկելու համար:
Մասնավորապես՝ 2019 թ.-ի հունվարի 1-ից մինչև դեկտեմբերի 31-ն ընկած ժամանակահատվածում տեղի ունեցած 5 ինքնասպանությունը իրականացվել է կախվելու միջոցով, իսկ մինչ այդ՝ 2011 թ.-ի հունվարի մեկից մինչև 2017 թ.-ի դեկտեմբերի 31-ն ընկած ժամանակահատվածում կատարված 27 ինքնասպանությունից 26-ն են կատարվել կախվելու միջոցով, ընդ որում՝ ազատությունից զրկված անձինք օգտագործել են ինքնաշեն պատրաստված պարան, կոշկաքուղեր, սավան և այլն:
Ազատությունից զրկված անձանց կողմից կատարվող ինքնավնասումների և ինքնասպանությունների կանխարգելման արդյունավետությունն ապահովելու նպատակով՝ առաջարկվում է լրացում կատարել ՀՀ կառավարության 2006 թ.-ի օգոստոսի 3-ի թիվ 1543-Ն որոշման մեջ:
Այսպես, «ՀՀ կառավարության 2006 թ.-ի օգոստոսի 3-ի թիվ 1543-Ն որոշման մեջ լրացում կատարելու մասին» կառավարության որոշման նախագծով առաջարկվում է՝ 1) նախատեսել, որ իրենց կյանքին, առողջությանը վնաս պատճառելու հակում ունեցող դատապարտյալներին և կալանավորված անձանց արգելվում է հանձնուքներով, փաթեթներով, ծանրոցներով ստանալ կոշկաքուղեր, սավան, գոտի, պարան և կյանքից զրկելու համար օգտագործվող հնարավոր այլ միջոցներ՝ այդ անձանց որպես բացասական հակում ունեցող հաշվառման վերցնելուց մինչև նման հաշվառումից հանելն ընկած ժամանակահատվածում,
2) նախատեսել, որ իրենց կյանքին, առողջությանը վնաս պատճառելու հակում ունեցող դատապարտյալներին և կալանավորված անձանց արգելվում է իրենց մոտ պահել կոշկաքուղեր, սավան, գոտի, պարան և կյանքից զրկելու համար օգտագործվող հնարավոր այլ միջոցներ՝ այդ անձանց որպես բացասական հակում ունեցող հաշվառման վերցնելուց մինչև նման հաշվառումից հանելն ընկած ժամանակահատվածում:
