Կենսաթոշակներին և նպաստներին վերաբերող նախագծեր
SOCIETYԱշխատանքի և սոցիալական հարցերի նախարարությունը հանրային քննարկման է ներկայացրել նախագիծ, որի ընդունման անհրաժեշտությունը պայմանավորված է ««Պետական կենսաթոշակների մասին» օրենքում լրացում կատարելու մասին» 2020 թ.-ի մարտի 4 ի օրենքի ընդունմամբ:
Մասնավորապես՝ սահմանվել է, որ կենսաթոշակը անկանխիկ եղանակով ստացող կենսաթոշակառուի՝ Հայաստանի Հանրապետությունում լինելը բանկի կողմից կարող է հաստատվել նաև առանց կենսաթոշակառուի բանկ ներկայանալու՝ կառավարության սահմանած կարգով: Այս դեպքում շահառուի` ՀՀում լինելը ճշտվում է երկու տարբերակով՝ 1) բանկի աշխատակցի՝ ՀՀ-ում շահառուի գտնվելու վայր այցելությամբ, 2) բանկի իր ներքին ընթացակարգերին համապատասխան՝ տեղեկատվատեխնիկական միջոցների կիրառմամբ ամրագրվում է շահառուի՝ ՀՀ-ում գտնվելը:
Նշվում է, որ նախագծով առաջարկվում է նաև երկարաձգել ընտանիքի սոցիալական գնահատման համակարգում հաշվառված ընտանիքներին վճարվող ընտանեկան նպաստի, սոցիալական նպաստի, հրատապ օգնության գումարների՝ անկանխիկ եղանակով վճարման համակարգի ներդրման ժամկետը: Այս դեպքում հարկ է հաշվի առնել այն հանգամանքը, որ ընտանեկան նպաստը, սոցիալական նպաստը, հրատապ օգնությունը վճարվում են կենսաթոշակների, նպաստների, պարգևավճարների և պարբերական բնույթ կրող դրամական այլ վճարների վճարման կարգից էականորեն տարբերվող մեխանիզմներով՝ բացառապես կանխիկ եղանակով:
Նշված վճարներն անկանխիկ եղանակով վճարելու նոր, գործուն մեխանիզմներ ներդնելու համար անհրաժեշտ է կատարել որոշակի նախապատրաստական աշխատանքներ: Նախագծով առաջարկվում է հստակեցնել կենսաթոշակ վճարելը դադարեցնելու հիմքերը՝ դրանց ավելացնելով սահմանված ժամկետում կենսաթոշակառուի՝ ՀՀում լինելու մասին բանկի հաստատումը:
Բացի սա, աշխատանքի և սոցիալական հարցերի նախարարությունը հանրային քննարկման է ներկայացրել մեկ այլ նախագիծ, որով առաջարկում է փոփոխություններ և լրացումներ կատարել կառավարության 2011 թ.-ի մայիսի 5 ի N 670-Ն որոշման մեջ: Ներկայացվող նախագծի ընդունումը պայմանավորված է նախկինում մի շարք օրենքների ընդունմամբ:
Օրենսդրական այդ փոփոխություններով էապես պարզեցվել է պարբերական և միանվագ բնույթ կրող վճարներն անկանխիկ եղանակով վճարելու վարչարարությունը: Ներկայացվող նախագծով առաջարկվում է` 1) կենսաթոշակի, պատվովճարի, ամենամսյա պարգևավճարի, ծերության նպաստի, հաշմանդամության նպաստի, կերակրողին կորցնելու դեպքում նպաստի և վնասի փոխհատուցման գումարներն անկանխիկ եղանակով վճարել շահառուի անվամբ բանկում բացված սոցիալական ապահովության հաշվին փոխանցելու միջոցով, 2) կենսաթոշակ ստանալու իրավունքը դադարեցնելուց հետո վճարման ենթակա` չվճարված կենսաթոշակը, կենսաթոշակառուի մահվան դեպքում տրվող թաղման նպաստը վճարվում են շահառուի ընտրությամբ` կանխիկ կամ անկանխիկ եղանակով (անկանխիկ եղանակով վճարվում է շահառուի անվամբ բանկում բացված միանվագ դրամական վճարների հաշվին փոխանցելու միջոցով):
