Իրավաբանական գիտությունների դոկտոր Արթուր Ղամբարյանը ֆեյսբուքյան իր էջում գրում է՝
Ինչպե՞ս կարելի է «մահվան դատապարտել» ՀՀ քաղաքացիների՝ անհատական դիմումներով Սահմանադրական դատարան դիմելու՝ բավականին դժվարությամբ ճանաչված իրավունքը (դրա արդյունավետությունը): Դրա համար բավարար է մեկ մարմնում (այսպես կոչած՝ Գերագույն դատարանում) միավորել վճռաբեկության և սահմանադրական արդարադատության գործառույթները:
Հեռու չգնանք՝ վիճակագրությունը վկայում է, որ Արցախում, որտեղ Գերագույն դատարանը, բացի վճռաբեկությունից, իրականացնում է նաև սահմանադրական արդարադատություն, անհատական դիմումների ինստիտուտը փաստացի չի գործում: 2009-2020թթ. վիճակագրության համաձայն՝ քաղաքացիները անհատական գանգատի հիման վրա Գերագույն դատարան են դիմել 9 գործով, որից՝ 8-ով Գերագույն դատարանը ՄԵՐԺԵԼ Է ԴԻՄՈՒՄԸ ՎԱՐՈՒՅԹ ԸՆԴՈՒՆԵԼ, 1 դիմում ընդունվել է վարույթ, սակայն Գերագույն դատարանը որոշել է, որ վիճարկվող Քաղ. դատ. օր-ի 247-րդ հոդվածի 1-ին մասը համապատասխանում է Սահմանադրությանը:
Անհատական դիմումով՝ Գերագույն դատարանի կողմից «օրենքի սահմանադրականության» հաստատումը շատ բնական է, քանի որ նույն Գերագույն դատարանն այդ գործը վճռաբեկության կարգով արդեն քննել է, և ի պաշտոն պետք է տեսներ նման հակասահմանադրականության վտանգ, և եթե չի տեսել նման բան, ոստի ինքնին ձևավորել է փաստացի կախվակարկած ըստ որի՝ այդ գործով նորմի հակասահմանադրականության հարց չկա: Բնականաբար՝ անհատական դիմումով, նույն գործը վճռաբեկության կարգով քննած Գերագույն դատարանը (պալատների առկայությունը անկարևոր է) դժվար թե «ունակ» լինի կամ ցանկություն ունենա տեսնելու այն, ինչ պետք է տեսներ վճռաբեկության կարգով գործը քննելիս:

Մեկ դատական մարմնում սահմանադրական արդարադատությունը և վճռաբեկությունը միավորելով՝ փաստացի մարդուց «խլում են» սահմանադրական արդարադատության մատչելիության (արդյունավետության) իրավունքը, որը 21-րդ դարում ոչ միայն մարդու հիմնարար իրավունքներից է, այլև սահմանադրականության (մշակութաբանական տեսանկյունից) ձևավորման միջոց է:
