Քննիչներն ավարտել են ոստիկանների նկատմամբ բռնության գործի նախաքննությունը

ՀՀ քննչական կոմիտեի Լոռու մարզային քննչական վարչությունում ավարտվել է ոստիկանների նկատմամբ բռնություն գործադրելու դեպքի առթիվ հարուցված  քրեական գործի նախաքննությունը: Ինչպես  տեղեկացրին ՀՀ քննչական կոմիտեի դեպարտամենտի տեղեկատվության և  հասարակայնության հետ կապերի բաժնից, նախաքննությամբ պարզվել է, որ Վանաձոր քաղաքի բնակիչը 2014 թվականի դեկտեմբերի 29-ին, ժամը 23:30-ի սահմաններում, Վանաձո ր քաղաքի Աղայան փողոցի 59/4 հասցեում գտնվող շենքի մոտ հարբած վիճակում փորձել է կանգնեցնել տաքսի ավտոմեքենա, որոնցից ոչ մեկը կանգ չի առել, ինչի պատճառով սկսել է բարձրաձայն հայհոյել:

Նշված վայրում  ծառայություն իրականացնող ոստիկանության Վանաձոր քաղաքի Բազումի բաժնի ՊՊԾ դասակի ոստիկանները, իրականացնելով իրենց ծառայողական պարտականությունները, պահանջել են, որ տղամարդը դադարեցնի հայհոյանքները և պահպանի հասարակական կարգը:

Քննությամբ բավարար ապացույցներ են ձեռք բերվել, որ, անտեսելով ոստիկանության աշխատակիցների օրինական պահանջը, տղամարդը քաշքշել է նրանց համազգեստներից, հայհոյանքներ հնչեցրել, ապա՝ հարվածել ոստիկաններից մեկի կրծքավանդակի առաջնային մակերեսին ու դեմքին։  

Մինչդատական վարույթի ընթացքում ձեռք բերված բավարար ապացույցների համակցությամբ՝ Վանաձորի բնակչին մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 316-րդ հոդվածի 1-ին մասով:

2015 թվականի հունիսի 23-ին քրեական գործը՝ մեղադրական եզրակացությամբ, ուղարկվել է նախաքննության օրինականության նկատմամբ հսկողություն իրականացնող դատախազին։  

Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորություննապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտածդատավճռով:
