Արտակարգ դրությունը կփոխարինվի կարանտինով․ ի՞նչ սահմանափակումներ են նախատեսվում
POLITICSԹեեւ սեպտեմբերի 11-ին, ժամը 18։00-ից սկսկած Հայաստանում կվերանա արտակարգ դրության ռեժիմը, այնուամենայնիվ համաճարակով պայմանավորված Կառավարությունը շրջանառություն մեջ է դրել արտակարգ դրությանը փոխարինող նոր կարգավորումներ նախատեսող օրենսդրական փաթեթ։ Կառավարության նախաձեռնությամբ սեպտեմբերի 4-ին գումարվեց Ազգային ժողովի արտահերթ նստաշրջան, որում էլ կքննարկվի հենց այդ փաթեթը։
«ՀՀ բնակչության սանիտարահամաճարակային անվտանգության ապահովման մասին» օրենքում փոփոխություն եւ լրացումներ կատարելու մասին եւ կից ներկայացված օրենքների նախագծերի փաթեթով՝ եթե վարակիչ հիվանդությունների՝ ՀՀ տարածք ներբերման (ներթափանցման), դրանց ծագման ու տարածման վտանգի, բռնկումների, համաճարակների առաջացման, ինչպես նաեւ դրանց հետեւանքով արտակարգ իրավիճակ առաջանալու դեպքերում կարող է սահմանվել կարանտին։
Լիազոր մարմնի առաջարկությամբ կարանտին կարող է սահմանել՝ Կառավարությունը, մարզպետը, Երեւանի քաղաքապետը։ Ուշագրավ է, որ կարանտին սահմանվելու պարագայում կիրառվելու են սահմանափակող այնպիսի միջոցառումներ, որոնք, օրինակ՝ արտակարգ դրության ժամանակ էլ էին կիրառվում։ Այսինքն՝ հույս ունենալ, որ արտակարգ դրության ռեժիմի վերացումից հետո սահմանափակումները կթուլանան կամ ընդհանրապես դրանք կհանվեն, մեղմ ասած՝ իրականությանը չեն համապատասխանում։ Կարանտին սահմանվելու դեպքում կիրառվող սահմանափակող միջոցառումներն են՝
1) համաճարակի (կարանտինային) գոտում մուտքի եւ ելքի հատուկ ռեժիմի սահմանում.
2) «Պետական սահմանի մասին» օրենքի 16-րդ հոդվածով նախատեսված պետական սահմանով հաղորդակցության ժամանակավոր դադարեցում կամ սահմանափակում.
3) անձանց ազատ տեղաշարժվելու իրավունքի եւ տրանսպորտային միջոցների տեղաշարժման սահմանափակումներ.
4) օբսերվացիա.
5) ինքնամեկուսացում.
6) մեկուսացում:
Ըստ օրենսդրական փաթեթի՝ սահմանված միջոցառումների կիրառումը չի կարող խոչընդոտել Ազգային ժողովի, Սահմանադրական դատարանի, դատարանների, Մարդու իրավունքների պաշտպանի, զինված ուժերի, ոստիկանության զորքերի եւ սահմանապահ զորքերի բնականոն գործունեությունը: Կարանտին սահմանելու մասին որոշմամբ կարող են կիրառվել անձանց ազատ տեղաշարժվելու իրավունքի եւ տրանսպորտային միջոցների տեղաշարժման հետեւյալ սահմանափակումները.
