5 գործ քննող դատավորը գերծանրաբեռնվա՞ծ, թե՞ իշխանությունների պատվեր
POLITICSԱյն, որ դատական համակարգը կոլապսի մեջ է, անզեն աչքով է տեսանելի: Թե այս անորոշ իրավիճակը դեռ ինչքան կարող է շարունակվել, ցավոք, ոչ ոք չգիտի: Պարզվում է, որ դատարաններում կան հայցեր, որոնք առանց հիմնավորման արդեն երկու տարի է հետաձգվում են, կան գործեր, որոնք ամենատարբեր պատճառաբանություններով վարույթ չեն ընդունվում: Որոշ դեպքերում էլ, ժամանակ շահելու համար գործերն ընդունվում են, բայց դրանք քնեցնելու համար ընկնում են այն շրջապտույտի մեջ, որից դուրս գալու ելքերը, այս պահին տեսանելի չեն:
Կորոնավիրուսի դեմ պայքարը տապալելու փաստի առթիվ քրեական գործ հարուցելու «Մեկ Հայաստան» կուսակցության նախագահ Արթուր Ղազինյանի կողմից ներկայացված հանցագործության հաղորդումը ՀՔԾ և Գլխավոր դատախազության կողմից մերժվեց: Քաղաքական գործիչը, սակայն, մերժման մասին որոշումները վիճարկելու համար դիմեց դատարան: Դատարանը թեև դիմումն ընդունեց, բայց, արդեն ավանդույթ դարձած պատճառաբանությամբ՝ դատավորի գերծանրաբեռնված լինելու և 80 էջ ծավալով գործին ծանոթանալու համար ժամանակ գտնելու պատճառաբանությամբ, նշանակված դատաքննության օրը ևս մեկ ամսով հետաձգվեց։
Բայց հետաքրքրին այն է, որ եթե մյուս դատավորների դեպքում գերծանրաբեռնված են համարվում 100 և ավելի գործեր քննողները, ապա դատավոր Մանվել Շահվերդյանի վարույթում այս պահի դրությամբ կա ընդամենը 5 քրեական գործ։
Դատավորի «գերծանրաբեռնվածության» լինելու մասին տեղեկանում ենք «Դատալեքս» տեղեկատվական համակարգից, բայց ուշագրավն այն է, որ Շահվերդյանը այն դատավորներից է, ում կարիերան սրնթաց վերելք է ապրել Փաշինյանի իշխանության գալուց հետո, երբ 2019թ. նոյեմբերին նշանակվեց Լոռու մարզի առաջին ատյանի ընդհանուր իրավասության դատարանի դատավոր, իսկ 2020թ.-ի մայիսի 5-ին տեղափոխվեց Երևանի ընդհանուր իրավասության դատարան:
Հարց է ծագում, թե ինչպե՞ս պատահեց, որ դատավոր Շահվերդյանն ընդամենը մի քանի գործ քննելով այնքան ծանրաբեռնված իրեն զգաց, որ չհացրեց Ղազինյանի նեկայացրած հայցին ծանոթանալ և առանց վարանելու որոշեց նիստը հետաձգել:
Եթե սա է Փաշինյանի պատկերացրած անկախ դատական համակարգը, երբ մի քանի գործի պարագայում դատավորը կարող է իրեն գերծանրաբեռնված համարել ու տարբեր պատճառաբանություններով ձգձգել նիստերը, ապա դժվար չէ պատկերացնել, թե դեռ ինչերի կարող ենք ականատես լինել:
Ստացվում է, որ կա՛մ նոր իշխանության ժամանակ նշանակված դատավորները նախկինների նման անկախ չեն, կա՛մ ներքին պայմանավորվածություն կա մեծ դադարներով դատերը վարելու, ուրպեսզի հասարակության ուշադրությունը դրանց վրա չսևեռվի:
Այսինքն, այս պահին կարող ենք փաստել, որ դատական համակարգը ոչ թե գործում է, այլ շարունակում է իր առանցքի շուրջ անկանոն պտտվել, առանց հաշվի առնելու, որ այդ ամենի պատճառով տորպեդահարվում է արդարադատության մի ողջ համակարգի գործունեություն, որը, փաստացի, շատ թանկ է նստում թե՛ քաղաքացիների և թե՛ պետական բյուջեի վրա:
