Փոփոխություններ «Բնության հատուկ պահպանվող տարածքների մասին» օրենքում

Շրջակա միջավայրի նախարարությունն առաջարկում է փոփոխություններ կատարել «Բնության հատուկ պահպանվող տարածքների մասին» և կից ներկայացվող օրենքներում: Նշվում է, որ փոփոխությունները պայմանավորված են գործող օրենքի մի շարք բացերով`

1. օրենքում բացակայում են բնության հատուկ պահպանվող տարածքների ստեղծման նպատակները և հիմքերը.

2. հստակ չեն շարադրված բնության հատուկ պահպանվող տարածքների կառավարման սկզբունքները.

3. բացակայում են բնության հատուկ պահպանվող տարածքների կատեգորիաների խնդիրները.

4. բացակայում են բնության հուշարձանի դասակարգումը, ստեղծման չափանիշները և պահպանության ռեժիմը.

5. բացակայում է արգելավայրի պահպանության ռեժիմը.

6. բացակայում են պահպանման գոտու, էկոլոգիական միջանցքի և էկոլոգիական ցանցի կառավարման սկզբունքները և պահպանության ռեժիմը.

7. բացակայում են կենսոլորտային արգելոցի ստեղծման և կառավարման հարցերը: Անհրաժեշտություն է առաջացել նաև համապատասխանեցնել այս օրենքը միջազգային չափանիշներին, մասնավորապես` ապահովել «Բնության պահպանության միջազգային միության» կողմից սահմանված բնության հատուկ պահպանվող տարածքների 5-րդ կատեգորիաների ստեղծումը և նպաստել տեղական ինքնակառավարման մարմինների ներգրավմանը բնության հատուկ պահպանվող տարածքների կառավարման գործընթացում: Այսպիսով՝ նախագծով առաջարկվում է բնության հատուկ պահպանվող տարածքների կառավարման ճկուն մեխանիզմի ներդնում, բնության հատուկ պահպանվող տարածքների կառավարման գործընթացում տեղական ինքնակառավարման մարմինների ներգրավում, նոր՝ վերականգնման գոտու սահմանում, սահմանվում են վճարներ բնության հատուկ պահպանվող տարածքների օգտագործման համար, հստակեցվում են մի շարք հասկացություններ և տրվում են նորերը: Առաջարկվող օրենքների նախագծերի ընդունմամբ կկարգավորվեն բնության հատուկ պահպանվող տարածքների ստեղծման, պահպանության, օգտագործման և կառավարման հարաբերությունները: Ներկայացված օրենքների նախագծերի ընդունումով առավել արդյունավետ կդառնան բնության հատուկ պահպանվող տարածքների կառավարման գործընթացները, ինչպես նաև մի շարք օրենքների նախագծերի ընդունման դեպքում անհրաժեշտություն կառաջանա սահմանելու բնության հատուկ պահպանվող տարածքների օգտագործման կարգը:
