2019թ. Թուրքիայում Էրդողանին վիրավորելու համար ավելի քան 3800 մարդ է ազատազրկվել
INTERNATIONAL NEWSՆոր զեկույցի համաձայն՝ անցյալ տարի Թուրքիայի նախագահ Ռեջեփ Թայիփ Էրդողանին վիրավորելու համար Թուրքիայում ավելի քան 3800 մարդ ազատազրկման է դատապարտվել:
Թուրքական BirGun լրատվական գործակալության փոխանցմամբ՝ թուրքական դատական համակարգը սույն մեղադրանքով 3831 ազատազրկման դատավճիռ է կայացրել, ինչը 87%-ով ավելին է, քան 2018-ին, երբ 2046 մարդ էր դատապարտվել:
Թուրքիայի քրեական օրենսգիրքը քրեական պատասխանատվություն է ենթադրում նախագահին վիրավորելու համար, իսկ օրինախախտին սպառնում է ազատազրկում ՝ առավելագույնը 4 տարի ժամկետով: Պատժաչափը կարող է ավելացվել, եթե վիրավորանքն արտահայտվում է հանրային ոլորտում:
Քանի որ վերջին չորս տարվա ընթացքում ձերբակալությունները շարունակում են աճել, իրավապաշտպան կազմակերպությունները կոչ են արել Թուրքիային դադարեցնել հետապնդումները «նախագահին վիրավորելու» համար, և կառավարությանը մեղադրել են այլախոհ ձայները լռեցնելու նպատակով օրենքն օգտագործելու համար:
Մերձավոր Արևելքի հարցերով միջազգային հարաբերությունների խորհրդի գիտաշխատող Հենրի Բարքիի խոսքերով` «Թուրքիայի դատական համակարգն ահռելի ճնշման տակ է գտնվում Էրդողանի հասցեին ցանկացած քննադատություն կասեցնելու համար»:
«Ամենակարևոր խնդիրն այն է, որ դատական համակարգը Թուրքիայում այլևս անկախ չէ. այն հիմնականում հետևում է նախագահական պալատի հրահանգներին»,-ասել է Բարքին Al Arabiya-ին տված հարցազրույցում:
Էրդողանի օրոք թուրքական կառավարությունը բարակ սահմանագիծ է դրել քննադատական մեկնաբանության և վիրավորանքի միջև, կարծում է աքսորված թուրք լրագրող Բյուլենթ Քենեսը:
2016-ի հուլիսին Էրդողանին քննադատող սյունակ գրելուց հետո Քենեսին մեղադրել և դատապարտել են երեք ցմահ և ևս 15 տարվա ազատազրկման: Նա խուսափել է պատժից և այժմ ապրում է Եվրոպայում:
«2015 թվականից սկսած ես մի շարք ազատազրկումների եմ դատապարտվել Էրդողանին վիրավորելու համար, պարզապես նրա հասցեին իմ սովորական քննադատության պատճառով: Ես կարող եմ ընդգծել այն փաստը, որ այսպես կոչված «վիրավորանքի» դեպքերի ճնշող մեծամասնությունը ոչ մի կապ չունի իրական վիրավորանքի հետ»,-ասել է Քենեսը Al Arabiya-ին տված հարցազրույցում:
Եվրոպայի խորհուրդը, որի անդամ է նաև Թուրքիան, կարծիք է հայտնել Թուրքիայի քրեական օրենսգրքի 299-րդ հոդվածի վերաբերյալ, որը քրեականացնում է կառավարության ղեկավարին վիրավորելը, և պնդել է, որ «պետք է հստակ տարբերակել քննադատությունն ու վիրավորանքը»:
Նախագահին վիրավորելու վերաբերյալ մեծ թվով հետաքննությունները «շատ հավանական է, որ սարսափեցնող ազդեցություն ստեղծեն ամբողջ հասարակության վրա», - ասված է խորհրդի` դեռևս 2016 թվականի հայտարարությունում:
Խորհուրդը նաև խոր անհանգստություն է հայտնել Քենեսի պես լրագրողների նկատմամբ բազմաթիվ մեղադրանքների առթիվ:
