Դպրոցում դիմակ կրելու պարտադրանքը հանելու մասին դատարանի որոշում չկա

Դպրոցում դիմակ կրելու մասին դատարանի որոշում չկա. փաստաբան Գեղամ Սիմոնյանի սոցիալական ցանցի միջոցով տարածած տեղեկությունն այն մասին, որ դպրոցում դիմակ կրելու պահանջը և մյուս սահմանափակումներն ապօրինի են և հաստատված դատարանի որոշմամբ, չի համապատասխանում իրականությանը:
Դատական տեղեկատվական համակարգում հրապարակված դատարանի որոշումը փաստում է, որ փաստաբան Գեղամ Սիմոնյանի կողմից ներկայացված դիմումը, կից փաստաթղթերով վերադարձվել է. «Դիմումում թույլ տրված սխալները վերացնելու և որոշումը ստանալու օրվանից հետո` տասնհինգօրյա ժամկետում վարչական դատարան կրկին ներկայացվելու դեպքում՝ այն վարույթ ընդունված է համարվում սկզբնական ներկայացման օրը»:
Բացի դրանից, փաստաբանը, մեջբերելով դատարանի որոշումը, նշում է, որ վարչական դատարանը 5 դատավորի կազմով հաստատված է համարել, որ Կորոնավիրուսային հիվանդության (COVID-19) պայմաններում հանրակրթական ուսումնական հաստատություններում գործունեության կազմակերպման ուղեցույցը նորմատիվ իրավական ակտ չէ և ենթակա չէ կիրառման և կատարման։ «Ինչից հետևում է, որ սկսած սեպտեմբեր 15-ից դպրոցներում կիրառվող սահմանափակումներն ապօրինի են և ոչ ոք իրավասու չէ այդ կարգը երեխաներին և ուսուցիչներին պարտադրել»,-նշում է նա։
Սակայն առհասարակ փակ տարածքներում, մասնավորապես՝ դպրոցում դիմակ կրելու արգելքը սահմանվում է ուղեցույցից ավելի բարձր իրավաբանական ուժ ունեցող փաստաթղթով՝ ՀՀ առողջապահության նախարարի՝ Անհատական պաշտպանության միջոցների ցանկը, կիրառման դեպքերն ու կարգը, սանիտարահամաճարակային անվտանգության կանոնները հաստատող՝ սեպտեմբերի 11-ի հրամանով, որի համաձայն՝ փակ տարածքներում դիմակ կրելը պարտադիր է բոլորի համար, բացառությամբ մինչև 5 տարեկան երեխաների, բնակության վայրում, անձնական ավտոմեքենաներով երթևեկելիս, ծխելիս, խմելիս, սնվելիս, ինչպես նաև Առողջապահության նախարարի կողմից հաստատված սանիտարական կանոններով սահմանված այլ դեպքերի:
Այսպիսով, դպրոցներում դիմակ կրելը պարտադիր է, քանի որ ոչ միայն չկա դատարանի որոշում՝ դիմակ կրելու ապօրինի լինելու վերաբերյալ, այլև դատարանում հարցի վիճարկումն արվել է սխալ, չի մատնանշվել իրավական նորմատիվային ակտ հանդիսացող համապատասխան փաստաթուղթը, որը նախարարի հրամանն է:
