Փաստաբանը՝ հանրաքվեի ժամանակ լրագրողների իրավունքների խախտման և պատիժների մասին

Հանրաքվեի ընթացքն ուղեկցվեց լրագրողների նկատմամբ բռնարարքներով:
Past.am-ը զրուցել է «Սարգսյան իրավաբանական խումբ» իրավաբանական միավորման ղեկավար, փաստաբան Տիգրան Սարգսյանի հետ և ճշտել՝ քրեական պատասխանատվության հիմքեր առկա՞ են լրատվամիջոցների ներկայացրած նյութերում և ինչ պատասխանատվություն կարող է կրել անձը լրագրողի օրինական գործունեությանը խոչընդոտելու համար:
Ըստ փաստաբանի՝ ՀՀ քրեական օրենսգրքի 164-րդ հոդվածը քրեական պատասխանատվություն է նախատեսում լրագրողի մասնագիտական օրինական գործունեությանը խոչընդոտելու համար:
Սարգսյանի խոսքով՝ նույն արարքները, որոնք կատարել է պաշտոնատար անձն իր պաշտոնեական դիրքն օգտագործելով, պատժվում են տուգանքով՝ նվազագույն աշխատավարձի չորսհարյուրապատիկից յոթհարյուրապատիկի չափով կամ ազատազրկմամբ՝ առավելագույնը երեք տարի ժամկետով՝ որոշակի պաշտոններ զբաղեցնելու կամ որոշակի գործունեությամբ զբաղվելու իրավունքից զրկելով՝ առավելագույնը երեք տարի ժամկետով կամ առանց դրա:
«Եթե լրագրողի մասնագիտական գործունեությանը խոչընդոտելն իրականացվել է լրագրողի կամ նրա մերձավորի կյանքի կամ առողջության համար վտանգավոր բռնություն գործադրելով կամ այն գործադրելու սպառնալիքով, ապա պատժվում են ազատազրկմամբ` երեքից յոթ տարի ժամկետով»,- նշել է մեր զրուցակիցը:
