Երեկ հայտնի դարձավ, որ ՄԻԵԴ-ը բավարարել է Հայաստանի կողմից Ադրբեջանի նկատմամբ միջանկյալ միջոց կիրառելու վերաբերյալ պահանջը: «Իրավական ուղի» ՀԿ համահիմնադիր Սիրանուշ Սահակյանը Past.am-ի հետ զրույցում նշեց, որ դեռ ամբողջական միջպետական գանգատ ներկայացված չէ:

«Իհարկե, գրանցված գործ կա, բայց հաշվի առնելով, որ իրավիճակին արագ են արձագանքել, առաջիկայում պետությունը նոր պետք է ամբողջացնի գանգատը: Այս փուլի համար, այնուամենայնիվ, ՄԻԵԴ-ը բավարարել է պահանջը և իր պրակտիկային համապատասխան միջանկյալ միջոցի հասցեատեր է դարձրել ոչ միայն պատասխանող, այլև դիմող պետությունը՝ այդ կոչն ուղղելով ինչպես Ադրբեջանին, այնպես էլ ՀՀ-ին. այսինքն, երկու կողմերն էլ պարտավոր են դադարեցնել ռազմական գործողությունները ու զերծ մնալ քաղաքացիական բնակչության և քաղաքացիական օբյեկտների նկատմամբ ոտնձգություններից: Առհասարակ հումանիտար իրավունքի միջազգային ստանդարտները պահանջում են, որ երբևիցե որևէ ռազմական կոնֆլիկտի շրջանակում քաղաքացիական օբյեկտները և բնակչությունը չդառնան թիրախ, բայց հաճախ հակամարտող կողմերը չեն պահպանում նորմերը: Այստեղ Եվրոպական դատարանը պարզապես իր իրավական գործիքակազմով է փորձում ներազդել հակամարտության վրա»,-ասաց նա:

Ս. Սահակյանի խոսքով, հետագայում հասցեականություն, իհարկե, ակնկալվում է. «Պարզապես նշեմ, որ երբ ՄԻԵԴ-ը որևէ կոնֆլիկտի հետևանքով բնակչության իրավունքների պաշտպանության խնդիրն է ստանձնում, փորձում է մի փոքր ավելի պարիտետային մոտեցմամբ գործել ու անկախ կոնֆլիկտի առանձնահատկություններից, կարծես, նույնական վարքագիծ է վերագրում երկու կողմերին էլ: Իհարկե, մինչ այս հայկական կողմի անհատական գանգատների շնորհիվ այդ մոտեցումը կոտրվել է. զուտ սահմանային միջադեպերով եղել են այնպիսի խնդիրներ, ինչպես առևանգված կամ մոլորությամբ Ադրբեջանի տարածքում հայտնված հայերի նկատմամբ խոշտանգումներն են, կյանքի իրավունքի խախտումները կամ այլ երկրներում գտնվող հայ քաղաքացիների նկատմամբ ոտնձգությունները: ՄԻԵԴ-ը հատուկ վերաբերմունք ունի այդ տեսակի գործերով, և այստեղ չենք կարող ասել, որ Հայաստանի և Ադրբեջանի վարքագիծը սիմետրիկ է: Բայց գլոբալ տեսանկյունից այս կառույցը երկու երկրների հետ փորձում է հավասարակշռված և նույնական մոտեցումներով գործել: Վստահորեն կարող ենք ասել, որ երկու-երեք տարվա ընթացքում կուսումնասիրի և քաղաքացիների խախտված իրավունքները որոշակի առումով կվերականգնի»,-ասաց նա:

Իսկ թե ՄԻԵԴ-ի վճիռները որքանով արդյունավետ կկատարվեն, Ս. Սահակյանի խոսքով, ցույց կտա ապագան. «Ուղղակի նոր տարր ունենք՝ դա միջպետական գանգատի առկայությունն է: Միջպետական գանգատ ՄԻԵԴ-ում մենք չենք ունեցել: Հետաքրքիր է նաև, թե Ադրբեջանը միջպետական գանգատ կներկայացնի՞ Հայաստանի դեմ, որի հավանականությունը ես առնվազն փոքր չէի գնահատի: Եվ հետաքրքիր կլինի տեսնել, թե նման երկու գանգատների առկայության պարագայում ինչպիսի մոտեցումներ կսկսի ձևավորել ՄԻԵԴ-ը: Կարևոր է, որ այս պահին միջանկյալ միջոց կա, բայց հատկապես ռազմականացված կոնֆլիկտներում միջանկյալ միջոցներին պետությունները հակված չեն հեշտությամբ լսել: Եվ եթե դրան չհաջորդեն ԵԽ-ի և եվրոպական այլ կառույցների լուրջ քաղաքական ճնշումներն Ադրբեջանի նկատմամբ, իրավունքը չի ազդի կոնֆլիկտի վրա: Շատ կարևոր է, որ հիմա այդ կառույցները լուրջ քաղաքական գործիքներ օգտագործեն Ադրբեջանի նկատմամբ, որ փաստացի կատարվի իրենց իսկ կողմից ընտրված միջանկյալ միջոցը»:
