Սահմանապահ զորքերի զինծառայողի մահվան դեպքի առթիվ 4 անձի մեղադրանք է առաջադրվել

ՀՀ ԱԱԾ սահմանապահ զորքերի N զորամասի պարտադիր ժամկետային զինծառայող, շարքային Գևորգ Խաչատրյանի մահվան դեպքի առթիվ ՀՀ քննչական կոմիտեի ԶՔԳՎ իններորդ կայազորային քննչական բաժնում քննվող քրեական գործով մեղադրանք է առաջադրվել 4 անձի։

2015թ. նոյեմբերի 28-ին ՀՀ ՔԿ ԶՔԳՎ 9-րդ կայազորային քննչական բաժնում ահազանգ էր ստացվել, որ նույն օրը՝ ժամը 22:50-ի սահմաններում, սահմանապահ ուղեկալի պարտադիր ժամկետային զինծառայող, շարքային Գևորգ Խաչատրյանը, լինելով պետական սահմանի պահպանության սահմանապահ վերակարգի կազմի մեջ, ստացել է հրազենային վնասվածք և տեղափոխվել զորամասի բուժկետ։ Պարզվել է, որ Գ.Խաչատրյանը գլխի գագաթային շրջանի հրազենային վնասվածքն ստացել է իրեն ամրակցված ԱԿ-74 147 9229 համարի ինքնաձիգով, և բուժկետում գրանցվել է նրա բիոլոգիական մահը:

Ինչպես «Արմենպրես»-ին տեղեկացրին ՀՀ քննչական կոմիտեի տեղեկատվության և հասարակայնության հետ կապերի բաժնից, դեպքի առթիվ ՀՀ քննչական կոմիտեի ԶՔԳՎ իններորդ կայազորային քննչական բաժնում հարուցվել է քրեական գործ՝ զինծառայողին ինքնասպանության հասցնելու դեպքի առթիվ, և ձեռնարկվել անհրաժեշտ քննչական գործողություններ՝ պարզելու պատճառները։

Ստեղծվել է քննչական խումբ, նշանակվել են մի շարք փորձաքննություններ, հարցաքննվել են բազմաթիվ վկաներ, կատարվել են անհրաժեշտ դատավարական այլ գործողություններ:

Նախաքննության ընթացքում զորամասի զինծառայողներ` կապիտան Մ.Ս.Ոսկանյանը, ավագ լեյտենանտ Հ.Ա.Վարդևանյանը,  շարքայիններ Հ.Ա.Մուրադյանը և Ա.Հ.Սարգսյանը ձերբակալվել են:

Կապիտան Մ. Ոսկանյանին մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 364.1-րդ հոդվածի 2-րդ մասով (զինծառայողի կողմից մոլեխաղեր կազմակերպելը կամ դրանց մասնակցելը), 375-րդ հոդվածի 1-ին մասով (իշխանությունը չարաշահելը, իշխանազանցությունը կամ իշխանության անգործությունը) և 360-րդ հոդվածի 2-րդ մասով (զինծառայողին վիրավորանք հասցնելը), ավագ լեյտենանյտ Հ. Վարդևանյանին՝ ՀՀ քրեական օրենսգրքի 375-րդ  հոդվածի 1-ին մասով և ՀՀ քրեական օրենսգրքի 375-րդ  հոդվածի 1-ին մասով (իշխանությունը չարաշահելը, իշխանազանցությունը կամ իշխանության անգործությունը),  շարքայիններ Հ. Մուրադյանին՝ ՀՀ քրեական օրենսգրքի 364.1-րդ հոդվածի առաջին մասով (զինծառայողի կողմից մոլեխաղեր կազմակերպելը կամ դրանց մասնակցելը), 359-րդ հոդվածի 1-ին մասով (զինծառայողների փոխհարաբերությունների կանոնագրքային կանոնները խախտելը՝ նրանց միջև ստորադասության (ենթակայության) հարաբերությունների բացակայության դեպքում (2 դրվագ), 360-րդ հոդվածի 1-ին մասով (զինծառայողին վիրավորանք հասցնելը),  Ա.Սարգսյանին՝ ՀՀ քրեական օրենսգրքի 359-րդ հոդվածի 1-ին մասով:

Ա. Ոսկանյանի  և Հ. Մուրադյանի նկատմամբ որպես խափանման միջոց է ընտրվել կալանավորումը,  իսկ Հ. Վարդևանյանի և Ա. Սարգսյանի նկատմամբ որպես խափանման միջոց կալանավորումը կիրառելու վերաբերյալ  քննիչների միջնորդությունները դատարանի կողմից չեն բավարարվել:

Նախաքննությունը շարունակվում է:

Ծանուցում. Հանցագործության մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորություննապացուցված չէ ՀՀ քրեական դատավարության օրենսրքով սահմանված կարգով՝  դատարանի՝ օրինական ուժի մեջ մտածդատավճռով:
