ԱՄՆ առեւտրի նախարարությունը TikTok-ի արգելափակումը հետաձգել է

ԱՄՆ առեւտրի նախարարությունը հետաձգել է միջոցառումների ուժի մեջ մտնելը, որոնք ամերիկյան ընկերություններին արգելում էին TikTok չինական սոցցանցին հոսթինգի եւ կոնտենտի առաքման ծառայություններ մատուցել, փոխանցում է «Ինտերֆաքսը»։

Օգոստոսին ԱՄՆ նախագահ Դոնալդ Թրամփը հրաման էր ստորագրել՝ ուղղված TikTok-ից բխող սպառնալիքի վերացմանը։ Հրամանի համաձայն՝ «Միացյալ Նահանգներում Չինաստանի ընկերությունների մշակած եւ նրանց պատկանող բջջային հավելվածների տարածումը շարունակում է սպառնալ Միացյալ Նահանգների ազգային անվտանգությանը, արտաքին քաղաքականությանը եւ տնտեսությանը»։

Երկրի առեւտրի նախարարությունը սեպտեմբերի վերջին հրապարակել էր գործարքների ցանկը, որոնց վրա տարածվել է նախագահական հրամանի հետ կապված արգելքը։ Գործարքների մեծ մասի արգելքը պետք է ուժի մեջ մտներ նոյեմբերի 12-ին եւ փաստացի նշանակելու էր ԱՄՆ-ում TikTok-ի արգելափակում։

Այդ միջոցառումների ուժի մեջ մտնելը հետաձգելու իր որոշման մեջ առեւտրի նախարարությունը վկայակոչում է Ֆիլադելֆիայի շրջանային դատարանի որոշումը, որը հոկտեմբերի վերջին դրանց կիրառման ժամանակավոր արգելք էր սահմանել։ Դատավոր Վենդի Բիթլսթոունը այդ ժամանկ նշել էր, որ կառավարության հրամանը «սպառնալիք է ներկայացնում տեղեկատվական նյութերի լիարժեք փոխանակմանը», եւ վարչակազմը, հավանաբար, գերազանցել է իր լիազորությունները՝ համաձայն Միջազգային արտակարգ տնտեսական լիազորությունների մասին (IEEPA) օրենքի, նշում է The Wall Street Journal-ը։ Հինգշաբթի ԱՄՆ կառավարությունը վերաքննիչ բողոք էր ներկայացրել դատարանի այս որոշման դեմ։

Առեւտրի նախարարությունից նշել են, որ TikTok-ի հետ կապված գործարքների արգելքը ուժի մեջ չի մտնի, մինչեւ դատարանն այս գործով նոր որոշումներ չընդունի։

Չինական ByteDance Ltd.-ը, որը պատկանում է TikTok-ին, նույնպես վիճարկում է ԱՄՆ իշխանությունների որոշումը, որոնք իրենից պահանջում են վաճառել սոցցանցի ամերիկյան ակտիվները։ Ինչպես հաղորդվել էր օգոստոսի 14-ին, ԱՄՆ նախագահ Դոնալդ Թրամփը հրաման էր ստորագրել, որով TikTok-ի ամերիկյան ակտիվների պոտենցիալ վաճառքի ավարտման ժամկետը սահմանափակել էր 90 օրով, այսինքն՝ այն պետք է ավարտվեր մինչեւ նոյեմբերի 12-ը։

ByteDance-ը սեպտեմբերին վաճառքի գործարքը համաձայնեցրել էր Oracle-ի եւ Walmart-ի հետ, որով նախատեսվում էր TikTok-ի ակտիվների փոխանցում նոր ընկերությանը՝ TikTok Global-ին։ Ըստ գործարքի պայմանների՝ Oracle-ն ու Walmart-ը ընդհանուր առմամբ ստանալու էին TikTok Global-ի 20 տոկոսը, ByteDance-ը՝ 80 տոկոսը։ Այն դեպքում, երբ ByteDance-ը 40 տոկոսով պատկանում է ամերիկյան ներդրումային ֆոնդերին, TikTok Global-ը, հաշվի առնելով Oracle-ի եւ Walmart-ի բաժինները, վերահսկվելու էր ԱՄՆ-ից ներդրողների կողմից։

Թրամփը նախապես աջակցել էր գործարքին, սակայն ԱՄՆ իշխանությունների կողմից դրա աջակցության հետագա գործընթացը դանդաղել էր։

CNBC-ն նշում է, որ ԱՄՆ առեւտրի նախարարության որոշումը չի վերաբերում ԱՄՆ օտարերկրյա ներդրումների կոմիտեի (CFIUS) մանդատին՝ կապված TikTok-ի ամերիկյան ակտիվների վաճառքի հետ։
