Կներդրվի հարկադիր կատարման մասնավոր համակարգ․«Փաստ»

«Փաստ» օրաթերթը գրում է
Արդարադատության նախարարությունն առաջարկում է հավանություն տալ կառավարության որոշման նախագծին՝ «Հարկադիր կատարման մասնավոր համակարգի ներդրման վերաբերյալ հայեցակարգին»։ Նախագծի հիմնավորման մեջ նշվում է՝ չնայած հարկադիր կատարման ոլորտում վերջին տասնամյակների ընթացքում իրականացված մի շարք բարեփոխումներին՝ Հայաստանում դեռևս առկա է հարկադիր կատարման համակարգի գործունեության արդյունավետության բարձրացման և պատշաճ որակի ապահովման հրատապ անհրաժեշտություն։
Մասնավորապես՝ առանձին հարկադիր կատարողների խրախուսման առկա գործիքակազմերը բավարար չեն՝ համարժեք արձագանքելու համար հարկադիր կատարողների առանձին ջանասիրությանը, կատարողական վարույթի առանձին տեսակների համար կատարողական ծախսերի չափերը հաստատուն են՝ անկախ կատարողական կոնկրետ վարույթով կատարված գործողություններից, կատարված աշխատանքի, տևողության, բարդության, ինչպես նաև կատարողական ծախսի ու հարկադիր կատարողի վարձատրության միջև առկա չէ ուղիղ համեմատական կապ։ Նշվում է, որ այս խնդիրները չեն կարող լուծվել պետական համակարգի մյուս օղակներից առանձին, պետք է պետական ողջ համակարգում վարձատրությունը բարձրանա կամ վերանայվի, ինչը պահանջում է պետբյուջեից ֆինանսական ահռելի ծախսեր, կա՛մ էլ ներդրվի այլընտրանքային համակարգ։
Այդպիսի այլընտրանքային համակարգ կարող է դառնալ մասնավոր հարկադիր կատարողների ինստիտուտը, որը իրենից ներկայացնում է մրցակցային համակարգ, այն է՝ յուրաքանչյուր հարկադիր կատարողի հաջողությունը և եկամտաբերությունը ուղիղ համեմատական է իր գործունեության արդյունավետությանը: Հարկադիր կատարման մասնավոր համակարգը հնարավորություն է տալու թեթևացնել պետական բյուջեի բեռը: Մասնավոր հարկադիր կատարման սուբյեկտներն ինքնուրույն և սեփական միջոցներով կկազմակերպեն իրենց և իրենց գրասենյակների գործունեությունը, ինչը ենթադրում է վերջիններիս կողմից իրենց գործունեության համար անհրաժեշտ տեխնիկական հագեցվածության ապահովում, գրասենյակի գործունեության կազմակերպում և այլն, ինչն իր հերթին պետության համար ինչպես ֆինանսական, այնպես էլ մարդկային ռեսուրսների խնայողության և առավել արդյունավետ օգտագործման հնարավորություն է ստեղծում։
Բացի դրանից, հարկադիր կատարման մասնավոր համակարգն ինքնաֆինանսավորվող է, և ավելին, որպես ձեռնարկատիրական գործունեություն իրականացնող սուբյեկտներ, հարկադիր կատարման մասնավոր սուբյեկտներն իրենց գործունեության արդյունքում ստացվող շահույթից պետությանը վճարում են հարկեր, ինչն ապահովում է մասնավոր համակարգի միջոցով հարկադիր կատարման արդյունքում պետբյուջեի եկամուտների ավելացում։
