Դանիայում պարբերականին տուգանել են Ջրահարսի հուշարձանի ծաղրանկարի հրապարակման պատճառով

Կոպենհագենի շրջանային դատարանը Berlingske պարբերականին պարտավորեցրել է վճարելու 285 հազար կրոն (43 հազար դոլար) տուգանք ծաղրանկարի հրապարակման պատճառով, որը վիրավորում է Ջրահարսի՝ Հանս Քրիսթիան Անդերսենի նույնանուն հեքիաթի հերոսուհու հուշարձանը, որը նաեւ Դանիայի մայրաքաղաքի գլխավոր խորհրդանիշներից մեկն է։ Նկարը հրապարակվել է անցյալ տարվա ապրիլին այդ ժամանակ տեղի ունեցող քաղաքական բանավեճերի ենթատեքստում, փոխանցում է ՏԱՍՍ-ը։
Պարբերականի դեմ գործը նախաձեռնել են հուշարձանի հեղինակի՝ քանդակագործ Էդվարդ Էրիքսենի ազգականները, որոնք ծաղրանկարը, որում ջրահարսը ներկայացված է կարմիր աչքերով զոմբիի տեսքով եւ «Չարիքը՝ Դանիայում» գրառմամբ, համարել են իրենց ժառանգած հեղինակային իրավունքի խախտում։ Դատարանը համաձայնվել է պնդմանը, որ նկարը մեծ նմանություն ունի Էրիքսենի քանդակին եւ ուստի չի կարող համարվել օրիգինալ ստեղծագործություն։ Դրանից բացի, այն Ջրահարսի կերպարը դիվականացնում է։ «Ակնհայտ է, որ այս կերպ Ջրահարսը զուգակցվում է քաղաքական գաղափարներին, աջ ծայրահեղականությանը եւ չարիքին»,- նշված է դատարանի հրապարակված որոշման մեջ։
Բացի տուգանքից, պարբերականը պետք է քանդակի ժառանգներին փոխհատուցի բոլոր դատական ծախսերը։
Berlingske-ի գլխավոր խմբագիր Թոմ Ենսենը համաձայն չէ պնդմանը, որ Ջրահարսի ծաղրանկարն իբր հուշարձանին նման է, եւ զարմացած է տուգանքի չափից։ «Լրատվամիջոցների համար խնդիր է, որ չի կարելի օգտագործել այնպիսի ազգային խորհրդանիշը, ինչպիսին Ջրահարսն է՝ հեղինակային իրավունքի հետ հակամարտության մեջ չմտնելով»,- նրա խոսքն է մեջբերել շվեդական SVT հեռուստաալիքը։
Բացի ծաղրանկարից, պարբերականը տուգանվել է նաեւ դեմքին պաշտպանական դիմակով Ջրահարսի լուսանկարի պատճառով, որը հրապարակվել էր այս տարվա ապրիլին՝ համավարակի բռնկման ժամանակ։
