Փաստաբանների պալատի խորհուրդը դատապարտում է վարչապետի կողմից արդարադատության իրականացմանն ուղղված միջամտությունը

Փաստաբանների պալատի խորհրդի այսօր կայացած նիստում որոշել է՝
- Դատապարտել Հայաստանի Հանրապետության վարչապետ Նիկոլ Փաշինյանի կողմից արդարադատության իրականացմանն ուղղված միջամտությունը:
- Հորդորել պետական մարմիններին և բարձրաստիճան պաշտոնատար անձանց զերծ մնալ դատական իշխանության անկախությունը և հեղինակությունը կասկածի տակ դնող որևէ գործողությունից:
- Հորդորել դատական իշխանության ներկայացուցիչներին գործել բացառապես Հայաստանի Հանրապետության Սահմանադրությամբ և օրենքներով իրենց վերապահված լիազորությունների շրջանակներում:
Խարհուրդը անդրադարձել է 2020 թվականի նոյեմբերի 30-ին վարչապետի մոտ հրավիրված իրավապահ համակարգի ղեկավարների, այդ թվում՝ դատական համակարգի ներկայացուցիչների մասնակցությամբ անցկացրած խորհրդակցության ընթացքում հնչեցված հարցադրումներին և արձանագրել է, որ
«ՀՀ փաստաբանների պալատի խորհրդի գնահատմամբ դատական իշխանության անկախության տեսանկյունից՝
- անթույլատրելի է ՀՀ վարչապետի կողմից դատաիրավական համակարգի ներկայացուցիչների, մասնավորապես՝ դատավորների հետ կոնկրետ քրեական գործերին առնչվող հարցերով խորհրդակցությունների կամ քննարկումների անցկացումը․
- մտահոգիչ են խորհրդակցության ընթացքում հնչեցված այն հարցերը, որոնք վերաբերվում են կոնկրետ քրեական գործերով (այդ թվում՝ ԱԺ նախագահի դեմ հարձակման գործով) կալանավորումը որպես խափանման միջոց կիրառելու միջնորդությունների բավարարմանը կամ մերժմանը»,- նշված է Խորհրդի նիստի որոշման մեջ:
«Տվյալ դեպքում ՀՀ վարչապետը, լինելով գործադիր իշխանության ներկայացուցիչ, մասնավորապես՝ գործադիր իշխանության բարձրաստիճան պաշտոնատար անձ, իր մոտ ի թիվս այլոց, մտահոգիչ օրակարգով խորհրդակցության է հրավիրել նաև դատավորների, ովքեր հանդիսանում են անկախ դատական իշխանության ներկայացուցիչներ:
Տվյալ դեպքում ստացվում է, որ ՀՀ վարչապետը հրապարակային կարգով դատական իշխանության ներկայացուցիչներին հստակ հարցադրումներ է տալիս իրենց կողմից արդարադատության իրականացման գործընթացի հետ կապված, որի իրավասությունը ՀՀ Սահմանադրությամբ չունի»:
ՀՀ փաստաբանների պալատի խորհրդի գնահատմամբ՝ ՀՀ վարչապետի նման գործողությունները (նման ձևաչափով խորհրդակցության անցկացումը և հնչեցված հարցերը) ո՛չ միայն ուղղակի միջամտություն են դատական համակարգի գործունեությանը, այլ նաև՝ կասկածի տակ են դնում դատական համակարգի հեղինակությունը և անկախությունը, քանի որ հարցադրում է արվում թե «...մեր գնահատականը ո՞րն է» կամ «ինչքանո՞վ է այս իրավիճակը պատշաճ արձագանք տեղի ունեցածին...»:
