Աղմկահարույց նախագծի մանրամասներից տեղյակ չէ նույնիսկ նախարարությունը. ինչո՞ւ է այն հրատապ. «Ժողովուրդ»

«Ժողովուրդ» օրաթերթը գրում է.

Կառավարության երեկվա նիստում չզեկուցվող նախագծերի շարքում ընդունված «Բարձրագույն կրթության եւ գիտության մասին» օրենքի նախագծի շուրջ աղմուկը չի դադարում: Նախագծի անցումային դրույթներում կարդում ենք. «Սույն օրենքի՝ ուժի մեջ մտնելուց հետո մինչեւ սույն հոդվածի 12-րդ մասին համապատասխան հանրային բուհերում եւ հանրային գիտական կազմակերպություններում կառավարման խորհուրդների ձեւավորումը այդ բուհերում ու գիտական կազմակերպություններում համապատասխան ոլորտի լիազոր մարմնի ղեկավարը հինգ տարուց ոչ ավելի ժամկետով նշանակում է ռեկտոր, տնօրեն»: Սա նշանակում է, որ բուհերի ռեկտորներին այսուհետ նշանակելու է նախարարը:

Այն, որ սա հակասահմանադրական է, այլեւս քննարկման ենթակա չէ: Սահմանադրության 38 -րդ հոդվածի (Կրթության իրավունք) 3-րդ կետը հստակ սահմանում է «Բարձրագույն ուսումնական հաստատություններն օրենքով սահմանված շրջանակներում ունեն ինքնակառավարման իրավունք՝ ներառյալ ակադեմիական եւ հետազոտությունների ազատությունը»:

Սակայն այստեղ ուշագրավ է մեկ այլ հանգամանք եւս. արդյոք այս փոփոխությունը վերաբերելու է միայն թափուր մնացած ռեկտորների պաշտոնների՞ն, թե՞ նաեւ գործող ռեկտորների, որոնք նախարարի սրտով չեն լինի: Հենց այս հարցերի պատասխանը ստանալու համար դիմեցինք ԿԳՄՍ մամուլի խոսնակ Գեղամ Մելիքբեկյանին, նա առաջարկեց հարցը գրավոր ուղարկել՝ խոստանալով կարճ ժամանակում պատասխանել, ապա զանգահարեց եւ ասաց, թե հարցին պատասխանելու համար իրավաբանական հարցեր կան, որոնք պետք է ճշգրտվեն:

Այսինքն՝ անգամ նախարարությունը չգիտի՝ ինչ նախագիծ է, ինչ է սահմանվելու նոր նախագծով, ում է վերաբերելու։ Ու այսքանից հետո հարց է՝ ինչու է նախագիծը հրատապ համարվել։
