Սահմանադրական դատարանը կքննարկի իր իսկ հարցը. «Ժողովուրդ»

«Ժողովուրդ» օրաթերթը գրում է.
Սահմանադրական դատարանն այս տարի եւ հաջորդ տարվա առաջին ամիսներին մի քանի կարեւոր նախագծեր պետք է քննարկի եւ որոշի՝ դրանք համապատասխանում են սահմանադրականությանը, թե ոչ:
Նախ՝ դեկտեմբերի 25-ին գրավոր ընթացակարգով նախատեսված է ՀՀ մարդու իրավունքների պաշտպանի դիմումի հիման վրա «ՀՀ դատական օրենսգիրք» սահմանադրական օրենքի 9-րդ հոդվածի՝ Սահմանադրությանը համապատասխանության հարցը որոշելու վերաբերյալ գործի քննությունը: Սակայն նշենք, որ ՄԻՊ Արման Թաթոյանն այս հարցով ՍԴ էր դիմել դեռ 2019 թվականի դեկտեմբերին, սակայն ՍԴ-ում տեղի ունեցող գործընթացները հետ գցեցին, դրա համար դիմումը քննարկվելու է ուղիղ մեկ տարի անց:
Իսկ դիմելու պատճառն էլ այն էր, որ օրենքով նախատեսված չէ դատարաններում գործերը ողջամիտ ժամկետում քննելու սահմանադրական պահանջի պատշաճ ապահովման ճկուն մեխանիզմ: Նա նկատել է՝ ստացվում է, որ օրենսդրական գործող կարգավորումների պայմաններում դատարանում գործի քննությունը կարող է տարիներով ձգձգվել եւ անհետեւանք մնալ դատարանի համար: Արդեն փետրվարին քննարկվելու է «Հայաստանի Հանրապետության Ազգային ժողովի պատգամավորների ընդհանուր թվի առնվազն մեկ հինգերորդի դիմումի հիման վրա` Ազգային ժողովի կողմից իր լիազորությունների իրականացման, Ազգային ժողովի կանոնակարգե սահմանադրական օրենքի 86-րդ հոդվածի 2-րդ եւ 7-րդ մասերի, 5-րդ հոդվածի 2-րդ մասի 4.2-րդ կետի՝ Սահմանադրությանը համապատասխանության հարցը որոշելու վերաբերյալ» գործը:
Նշենք, որ այս դիմումով ընդդիմադիր խմբակցությունները պահանջում էին սահմանադրական փոփոխությունների գործընթացն առ ոչինչ համարել: Սահմանադրական դատարանը որոշել է դատաքննությունն անցկացնել գրավոր ընթացակարգով։ Որպես պատասխանող կողմ՝ ներգրավված են հանրապետության նախագահը, Ազգային ժողովն ու կառավարությունը: Այստեղ ուշագրավն այն է, որ հենց այս փոփոխությունների արդյունքում են այժմ Արթուր Վաղարշյանը, Էդգար Շաթիրյանն ու Երվանդ Խունդկարյանը զբաղեցնում ՍԴ անդամի պաշտոնը, իսկ Հրայր Թովմասյանն էլ նախագահից դարձել է շարքային անդամ: Ստացվում է՝ Սահմանադրական դատարանի անդամներից 9-ից 4-ը քննելու են մի դիմում, որն անմիջականորեն հենց իրենց է վերաբերում:
