«Փաստ» օրաթերթը գրում է

Էկոնոմիկայի նախարարությունն առաջարկում է լրացումներ կատարել քաղաքացիական օրենսգրքում։ Ներկայացվող նախագծի ընդունման արդյունքում հնարավոր կլինի ժառանգության բացման օրվանից 7 աշխատանքային օրվա ընթացքում ստանալ ժառանգության իրավունքի վկայագիր, եթե ժառանգատուի մահը պայմանավորված է COVID-19 համավարակով կամ պատերազմական գործողություններով: Նշվում է, որ սրա արդյունքում տնտեսվարող սուբյեկտները հնարավորություն կստանան շարունակել իրենց բնականոն գործունեությունը։

Նախագծի հիմնավորման մեջ ասվում է, որ դրա ընդունումը պայմանավորված է երկրում ստեղծված համավարակային և պատերազմական գործողությունների հետևանքով մահացած անձանց ժառանգության իրավունքի վկայագիրը ժառանգության բացման օրվանից ժառանգներին հնարավորինս սեղմ ժամկետում տրամադրելու անհրաժեշտությամբ։ Ներկայումս օրենսդրական կարգավորման համաձայն՝ ժառանգության իրավունքի վկայագիրը տրվում է ժառանգության բացման օրվանից վեց ամիս հետո։

Նշված իրավակարգավորումը որոշ դեպքերում բացասական ազդեցություն է ունենում տնտեսվարող սուբյեկտների հետագա գործունեության վրա։ Մասնավորապես, եթե մահացած անձը հանդիսանում է իրավաբանական անձի միակ մասնակիցը կամ բաժնետերը և միաժամանակ նաև տվյալ իրավաբանական անձի տնօրենը, ապա համապատասխան բաժնեմասի, ինչպես նաև ժառանգատուի բանկային հաշիվներում առկա դրամական միջոցների ժառանգության գործընթացը գործող օրենսդրական կարգավորումների համատեքստում կատարվում է ժառանգության բացման օրվանից վեց ամիս հետո, ինչը գործնականում խոչընդոտներ է առաջացնում տվյալ ընկերության հետագա գործունեության համար։

Այսպիսով՝ նախագծի ընդունման պարագայում համավարակի կամ պատերազմական գործողությունների հետևանքով մահանալու փաստի առկայության դեպքում կկրճատվի ժառանգության իրավունքի վկայագրի տրամադրման ժամկետը տնտեսվարող սուբյեկտների հետագա գործունեությանը չխոչընդոտելու նպատակով։ Նշվում է, որ քաղաքացիական օրենսգրքում այս լրացումները կատարելու դեպքում այլ նորմատիվ իրավական ակտերի ընդունման անհրաժեշտություն չկա, ինչպես նաև չեն նախատեսվում ծախսեր պետական բյուջեում։
